Richmond circuit court judge has ruled that a Radiology group, the alleged studies be sued for years incorrectly can not, because the Statute of limitations had expired.

In this case Radiology associates of Richmond, Inc., filed against the patient claims, that the defendant negligently performed and interpreted various X-rays from December 2002 to October 2005. She claimed that during this time with a tumor in the trigeminal of brain on the right they symptoms side of her face issued.

The Richmond circuit court rejected an argument that the "continuous treatment rule" applies to discrete radiological examinations. The Court ruled that it is in essence no "takeover of the ongoing treatment".

In this case probably interpreted Virginia law properly but the law is anachronistic and outdated. It is unbelievable that in this day and age, a patient with reference to years could report, after years of radiologists, deny justice be if it is a tumor is out, along the patient was the opportunity.

This is Virginia tort reform to the point.
