Virginia divorce lawyer sues be malpractice carriers and WINS

Terry Batzli, a practicing family law received damages in a lawsuit filed against its legal malpractice carrier.  A federal jury in favor of the Batzli and his company and therefore Richmond found $8,400 awarded damages.

Batzli had represented Richard Chasen in 2006 in his divorce from Karen Chasen. Richard claims that he has Batzli said he wanted Karen's 20-percent share of the family business.  This proposal was made to Karen, but there was no response, so Batzli an agreement developed that Richard would get "his" interest only, instead of his and Karen's interest.   This contract was signed before the bug was found.  Batzli will try to correct the error, by filing "error correct scrivener's motion" in August 2006.  Richmond circuit court denied the motion and the denial was later confirmed by the Virginia Court of appeals.

Richard sued for legal malpractice in 2009 Batzli.  Minnesota Lawyers Versicherungsgesellschaft AG, which was Batzli malpractice carrier, notified of the action.  Misconduct institution gave however, that it was too late to the notice of the claim and filed a Dec action in Richmond, U.S. District Court.

Minnesota Lawyers mutual insurance company made the claim that Batzli had knowledge of sufficient facts, "more than two years before the date of publication" who supported a claim that could to the carrier.  Batzli from a counter-claim for breach of contract and brought his claim for damages of a jury who find his favour ended.
