The danger of drinking and driving cannot be overstated. As a Seattle car accident lawyer, I see entirely too many cases of people whose lives have been turned upside down by drunk drivers. Late Sunday night, Candice Baima of Gig Harbor lost her life after a head-on collision with a 63-year-old driver who is believed by state troopers to have been under the influence, according to KIROTV.com. Ms. Baima died at the scene of the accident, and her 14-year-old daughter, who was in the car with her, was taken to Mary Bridge Hospital. The driver of the other vehicle was taken to St. Joseph Hospital.
As is the case in many fatal car accidents, this tragedy has left at least one child without a mother. Ms. Baima’s family can never replace the loss that it has suffered, and certainly their focus at this terribly difficult time will be on mourning the loss of a loved one. Sadly, they are not alone. Nearly one third of the over 30,000 traffic fatalities that occurred in 2009 were alcohol related, according to the Centers for Disease Control and Prevention (CDC). This statistic is a shocking reflection of a big problem in our society.

Walmart Heiress Arrested For Drunk Driving
AppId is over the quota
As a Weatherford personal injury lawyer, it never ceases to amaze me how often celebrities, athletes and other public figures are busted for drunk driving. I’m sure they realize how dangerous it is, so do they think that just because they’re rich and famous the law doesn’t apply to them? The latest person of interest to be arrested for driving while intoxicated is Walmart Heiress Alice Walton, 62, Parker County.
According to the Texas Highway Patrol, Walton was pulled over on I-20 in a construction zone near South Main Street in Weatherford shortly after 10pm last night. She was initially stopped for a traffic violation but when the arresting officer suspected that she might be over the legal alcohol limit, he administered a field sobriety test. She failed.
This is not the first time that Walton has been in trouble for her hazardous driving. In April 1989, she killed a pedestrian, Oleta Hardin, 50, although no charges were ultimately filed. In 1998, she was again driving under the influence of alcohol when she crashed her car into a gas meter. She is alleged to have told the responding officer, “I’m Alice Walton, bitch!” She got off with a fine.
Seeing people like this – regardless of who they are - who have repeatedly gotten behind the wheel when they know full well they are not capable of safely operating a vehicle should be penalized to the fullest extent of the law possible. Walton has already gotten off easy on two prior dangerous driving incidents, this is strike three. It should not be tolerated.
There is never any excuse for drunk driving. It doesn’t matter who you are. If you want to put your own life at risk, fine. But by getting in the driving seat after drinking you are jeopardizing other people’s safety too. That is inexcusable. Whenever someone hires me as their attorney after being injured by a drunk driver I do not hesitate to pursue their claim for compensation as aggressively possible. Drunk drivers need to be taught a lesson.
Certain Drunk Driving Behavior Is Particularly Reprehensible
AppId is over the quota
While any driver who climbs behind the wheel while intoxicated places other drivers, bicyclists, pedestrians and even passengers in the intoxicated driver’s own vehicle in danger, there are sometimes cases that are shocking, even for an experienced Atlanta auto accident attorney.
A Clayton County woman was cited for DUI when she plowed into a family picnic area wiping out two picnic tables while driving with a blood alcohol level of .392%, which is an appallingly high level that amounts to five times the legal limit. After plowing into the picnic area, the drunk driver then reportedly drove under a fence, through a ditch and then the wrong way on Ga. 42 before crashing into the stairs of the property’s leasing office.
Drunk drivers are responsible for a completely unacceptable toll in serious injuries, wrongful death and staggering medical and property costs. A few statistics from studies compiled by MADD provide a more complete picture of the problem:
Every minute around the clock a drunk driver injures another person. One in three drivers will be involved in an alcohol-related accident during their lifetime.A person is killed in a drunk driving accident in the U.S. every fifty minutes.Drunk driving costs every U.S. citizen $500 per year. There are many forms of negligent or reckless conduct that can lead to Georgia car accidents, but drunk driving is particularly avoidable. Those who drive with five times the legal limit recklessly put others at risk. While anyone can make a mistake, this is not typically the situation with drunk drivers that cause serious injuries or fatalities in drunk driving accidents. The typical person arrested for DUI has driven under the influence of drugs or alcohol 87 times before they are arrested for the first time.
DUI penalties also are fairly inadequate at deterring drunk driving. Though a drunk driver will typically face a license suspension, 50-75 percent of drivers who have had their license suspended continue to drive after the suspension according to a study conducted on behalf of the Transportation Research Board. While a driver who has a repeated pattern of driving under the influence of alcohol or drives with extremely high BAC may be liable for substantial punitive damages, this is little consolation for such tragedies as the accident victim who can no longer walk again after being paralyzed or the parent that loses their child in a Georgia car accident with a drunk driver.
Our experienced Atlanta DUI accident attorneys have been representing the victims of drunk drivers on Georgia streets and highways for over 27 years. We understand that a personal injury judgment against a drunk driver who causes serious injury to you or your loved one cannot take away your pain or loss, but it can provide the financial means to aid your recovery and provide the financial support to improve an accident victim’s quality of life.

Dallas Road Worker Seriously Hurt By Drunk Driver
AppId is over the quota
Yesterday I wrote about a city of Irving worker getting hit by a suspected drunk driver while picking up highway cones and it seems another accident just like it happened in Dallas early this morning. A Dallas road construction worker was seriously hurt after a motorist hit him.
Dallas highway crews had the two right lanes of I-30 near St. Francis Avenue coned off when a Honda drifted into the construction zone and hit the worker. When police got to the scene of the accident they performed a field sobriety test on the Honda’s driver and what did they find? Well for one, that the guy was intoxicated and also a little white powdery substance in his pocket. Now the impaired driver faces an Intoxication Assault charge and possible more charges as authorities test the white powder in his pocket to see if it’s illegal drugs. (My guess is yes.)
Drunk or drugged drivers don’t only face criminal legal action against them for their crimes; their victims can take civil action against them, too. At the Anderson Law Firm in Fort Worth, we sue drunk drivers for hurting our clients. Many people don’t understand that the civil case is very different from the criminal case the drunk driver faces. Although the criminal case will get the drunk driver punished either by paying a fine, serving time or restricting a driver’s license – it will do nothing to pay back those that were innocent victims in the accident. Only in a civil case can you ever win money for the injuries the drunk driver forced you to have.
Learn about your legal rights after a drunk driving accident in DFW – you have a lot more options than you think.
Seattle Car Accident Lawyer | Drunk Driver Flees From Crash Scene on Foot
AppId is over the quota
As a Seattle hit-and-run accident attorney, I see all too frequently what happens when drivers flee the scene of an accident. Usually, there is some reason why the driver who left the scene wanted to be removed from the situation, but often they either turn themselves in or are tracked down because a witness saw a license plate number or was able to describe the vehicle and driver. Many of these cases turn out to be like an incident that KIROtv.com reported Friday morning in which a driver who was believed to be under the influence of alcohol crashed into a guard rail after leaving Snoqualmie Casino, got out of the car and ran away. According to police, the wreckage caused several other cars to crash as well. Later, family members of the driver returned to the vehicle to recover items that were left in the car. This type of accident is, unfortunately, not uncommon here in western Washington, and while we don’t know whether any of the drivers of the other vehicles involved were injured, certainly there was the potential for this accident to be horrific.
Information provided by the National Highway Transportation Safety Administration shows 19 fatal hit-and-run crashes in the State of Washington in 2009. The obvious complication to recovering financial damages after a hit-and-run accident is whether or not the driver who fled the scene can be identified, but in many cases witnesses are able to help the police identify the driver.
After being injured in a hit-and-run accident, it can be difficult to know how to proceed. As with any injury, the most important thing is your health, and the health of your family. However, there are serious and important financial and legal considerations, for which you need the help of a qualified, experienced Snoqualmie hit-and-run accident attorney. Jason Epstein is a knowledgeable, aggressive Seattle personal injury lawyer who will fight for your legal rights. For more information, and a FREE CONSULTATION, contact Jason at Premier Law Group at (206)285-1743.
