Tiffany Stabler was a family you come along with her friend driving when they lost control of the vehicle. Both girls failed seat-belts, which ejects to two teenage passengers from the vehicle.

False latching is one of the more frequent seatbelt defects. It occurs when a seat belt latch sounds and/or feels as it is fully involved in, when in fact it is not safely locked. Because the locking not fully participating, the buckle is created unlatched during the force of a vehicle impact. Before the fatal accident, Kia had nearly 90,000 vehicles for a similar false latching damaged vehicles from model years 1995-1998 reminded. KIA recall, not models from 1999 to 2000 as an upgrade installed. During the wrongful death lawsuit has been shown that some vehicles manufactured in the callback's had the same upgrade.

A key issue in defective seat belt product liability lawsuits is the question of whether the passengers actually wore a safety harness. The defense in this lawsuit claims that the car crash victims out of the car were ejected because they wearing not seat belts. Although Tiffany with carry brands that the coroner had witnessed a safety harness are consistent, the Defense claimed the roof rail the chest injuries caused when she was ejected from the vehicle. The other passenger also testified that she and Tiffany were wearing seat belts.

While the vehicle recall later was extended so that Tiffanys vehicle have considered it, would the callback extension came too late to prevent Tiffanys tragic death. Evidence was provided that the original callback $2.5 million in costs. The jury probably accepted the claim that the recall was delayed, to avoid costs associated with having regard to an another 250,000 vehicles.
