Last week I moderated the morning session of the national conference for the American Association for Justice's Trucking Litigation Group. This is a group of truck accident attorneys from around the country, as well as lawyers who are learning how to handle their first truck accident cases. This is the sort of continuing legal education you want your lawyer to have if they are going to handle your  trucking case. See my prior post on "how to hire a great truck accident lawyer"

The litigation group’s mission is to educate and prepare lawyers on how to handle truck accident lawsuits and to work with safety authorities on the national and state level to make trucks safer on the roads and to reduce the number of truck wrecks. I am a past  president of the trucking litigation group.

The program this year was terrific.  Some of the topics that were covered include:

•    Introduction for lawyers to truck accident cases
•    Teaching jurors the dangers of trucks
•    The opening statement in a truck accident lawsuit
•    Using the special rules and regulations governing the trucking industry  in  depositions
•    Preparing the truck accident case for trial
•    Closing arguments in a trucking case.

This conference was in New York and is part of the American Association for Justice summer convention. I enjoyed helping my fellow injury attorneys better understand how to represent and protect their clients, and in particular the truck accident victims who have been harmed by negligent trucking companies.

One of the most common injuries for survivors of a truck accident is a Traumatic Brain Injury (TBI). These are actually traumatic brain damage cases because people don't get well from these injuries. As a result of handling large numbers of these cases for clients I have developed a sub-specialty in the area of TBI. Recently my hard work paid off and I was elected to the Board of the American Association for Justice's Traumatic Brain Injury Litigation Group (TBILG). This is the largest group of lawyers in the country representing those injured through the negligence of others. I look forward to helping other lawyers across the country handle these cases.

Some facts have become apparent in these cases : 

ER doctors don't focus on TBI injuries because they wont kill you immediately, and that is all the ER doc is concerned about.In Mild Traumatic Brain Injury (MTBI) cases family members are in the best spot to determine the extent of the injury and the changes to the victim.A loss of consciousness is not needed in order for a TBI to occur

I highly recommend that anyone that believes they, or a loved one, has a MTBI or a TBI, review the government's Center for Disease Control website and publications on TBI's. The government website can be found HERE.

This week is National Child Passenger Safety Week, which serves as a reminder that while we’re getting better about buckling up our kids in the backseat, motor vehicle crashes are still the leading cause of death for children between ages of 3 and 14.

The National Highway Traffic and Safety Administration (NHTSA) is using this week to promote child safety education for parents. A new study from Safe Kids USA indicates that while almost all parents are restraining car seats in the backseat, only 28 percent of drivers who carry young passengers are properly using the tethers that secure child seats in collisions. Often the inspected tethers were secured too lowly or not at all. The tethers are a vital safety measure because they keep children’s heads from moving too much during crashes.

The study also raised concern that many parents are not aware of the latest best safety practices for children of different heights and weights. For instance, in 2010 the American Academy of Pediatrics updated their guidelines to recommend that children under two ride in rear-facing seats. However a recent poll showed that only 27 percent of parents had received that message. Almost three quarters of parents reported turning their kids around before year two, and 30 percent before year one.

The results are somewhat alarming considering that, according to the NHTSA, properly used child safety seats decrease the risk of death by 71 percent for infants and 54 percent for toddlers. Even older children are 59 percent less likely to be injured in a booster seat than if they were using seat belts only.

To help educate the local Contra Costa County community, the firefighters from Local 1230 are ramping up their driver education services. The Fire District now has seven nationally certified Child Passenger Safety Technicians who can inspect cars and educate parents and caregivers on the best practices for child passenger safety seats.

The Fire District says that inspections last between a half hour and an hour, depending on the seat and whether any issues are found. These inspections are a convenient and free way for parents and caregivers to make sure that they are using the seat correctly, and that the seat itself has not been recalled. In addition to the inspection, the safety technicians will educate parents on the latest in child passenger safety, and go through the proper way to install child seats.

For the finale of Child Passenger Safety Week, certified child safety seat technicians will be on hand at locations around the country to inspect cars and assist with correct installation.

Requires STANDUP all States if signed into law, to comply with in order to receive federal highway construction program funding and grants. Non-compliant government money would be in States that comply with the law. US Congressman Randy Hultgren (R - IL) is one of the sponsors of the law and even if many of the proposed amendments meet Illinois, Hultgren white first-hand the importance of the safe teen driving, with 17-year-old in the household. The biggest change for Illinois teen drivers are age for a learner permit until increase 15 years age of 16.

Last week I hosted litigation group of the morning session of the National Conference for the American Association for Justice trucking. This is from a group of truck accident attorneys around the country, as well as the lawyers who learn how to handle their first truck accident cases are. 10 May 2011 - may is national motorcycle awareness month and the California Highway Patrol is use this time to tell the driver that they share the road with two wheeled vehicles.

The California Highway Patrol has issued the 2009 crash numbers motorcycle, which show the injuries and deaths that have occurred during the year in the State of California.
