Fatal Carroll County Bus Driver Was Sleepy from Taking Cough Syrup

Fatal Carroll County Bus Driver Was Sleepy from Taking Cough Syrup

The issue of sleepy drivers is a matter of great concern that can cause Georgia auto accidents that result in serious injury or wrongful death.

Many people take medications, whether prescription medications or over-the-counter drugs, that can either make a driver sleepy or exacerbate the effects of driver fatigue. We wrote recently that a school bus driver trainee that was involved a fatal school bus accident entered into a plea agreement that resulted in probation.

A media report indicated that the school bus driver may have been sleepy because he was under the influence of cough syrup. It has been widely reported that the driver had run over a dog earlier in the day and was observed struggling to keep the bus in its lane of traffic. A trainer was onboard and apparently observed all of this activity and noted it but did not intervene. The bus driver’s toxicology screening was negative for illegal drugs and alcohol but was positive for brompheniramine, an ingredient used in cough medication that can cause sleepiness and fatigue.

These tragic new details only add to the sad reality that this was an easily avoidable tragedy. When an employer or a supervisor for an employer has knowledge that an employee is not fit to operate a vehicle, the employer may be liable for injuries or wrongful death resulting from a collision involving a driver who is negligently entrusted with a motor vehicle. An employer should never entrust an employee who is not fit to drive with a car, truck or SUV, and especially a commercial driver like a bus driver or tractor-trailer driver who is sleepy, ill or taking medications that impair driving ability. The information that the driver in the fatal Carroll County school bus accident was sleepy because he had taken cough syrup only adds to the growing body of evidence of negligence on the part of the trainer and the school district.

Sleepy driving is a problem that most people recognize as unacceptable and dangerous but engage in despite the risk of causing a serious Atlanta car crash. According to the Insurance Networking News, 85 percent of drivers identify sleepy driving as an unacceptable driving practice. Despite this widespread view, 41 percent of drivers admit to having fallen asleep behind the wheel at some point based on data from AAA. Anyone driving when they are tired faces a serious risk of being involved in a sleepy driving accident. The risk is not only that drivers may be injured in sleepy driving accidents but that there also is an extremely high risk of sleepy driver accidents resulting in fatalities. Tired drivers account for over 16 percent of all auto accident fatalities according to the National Highway Traffic Safety Administration (NHTSA).

If you are tired either because of illness, side effects of medication or lack of sleep, it is important to stay off Atlanta roadways to avoid fatigued auto accidents. The experienced auto accident attorneys at Montlick and Associates, Attorneys at Law, recognize that tired drivers pose a serious danger of causing drowsy driving accidents in Atlanta and throughout Georgia.

If you are injured by a tired driver in a crash caused by driver fatigue or a driver who falls asleep at the wheel, our experienced Atlanta personal injury lawyers have been representing victims of fatigued drivers for nearly 30 years.  Our Atlanta accident lawyers are available to assist clients throughout all of Georgia and the Southeast, including but not limited to Albany, Athens, Atlanta, Augusta, Columbus, Gainesville, Macon, Marietta, Rome, Roswell, Savannah, Smyrna, Valdosta, Warner Robins and all smaller cities and rural areas in the state. As a Seattle car accident attorney, I understand the devastation that car accidents can bring to victims as well as the family members of those victims. Automobile accidents occur in all different kinds of situations and circumstances. When driving a car is your job, the risk of being injured in a car crash increases dramatically. According to KOMOnews.com, on October 16th, an Indianapolis 500 winner died in a horrific crash at the Las Vegas Motor Speedway. Driver Dan Wheldon was killed during a race that resulted in a 15 car pileup. After two cars touched wheels and lost control sending both cars in different directions, it was difficult for other drivers to avoid the wreckage. It was then that Wheldon’s car flipped over another vehicle and landed in a catch fence. Several cars caught on fire and two other drivers were also injured in the destructive crash. Race cars are built to withstand disastrous auto crashes and when a fatality does occur it devastates the whole nation.

Car accidents are dangerous no matter how tricked out with safety gadgets. New innovations in car safety continue to improve in everyday consumer vehicles but as seen in this racing accident, even the safest of cars are subject to fatalities.  Being aware of your surroundings and a cautious driver may help keep you from having to rely on manufactured safety.

Speed and alcohol don’t go together and unfortunately one group of friends is learning that in the worst way possible. Bellevue Car Crash Lawyer | Motorcycle Crash on West Seattle Bridge Turns Fatal

As a Seattle motorcycle accident attorney, I know that riding a motorcycle can be more hazardous than driving a car; aside from lacking the basic safety features of cars such as seat belts and air bags, taking evasive action on a motorcycle can sometimes cause the driver to wreck even while avoiding the original accident.  On Tuesday morning, Bradly Gilmore crashed his motorcycle on the West Seattle Bridge, while commuting to work in Bellevue, as reported by the Seattle Times.  In an attempt to avoid a collision with a car that was changing lanes, he broke heavily on his rear wheel, locked the wheel and was taken to Harborview Medical Center with head and facial injuries.  Mr. Gilmore died from the injuries Wednesday morning at Harborview, leaving behind a wife and four children.

Unfortunately, accidents like this one are not isolated incidents; over 4000 motorcyclists are killed annually across the country according to the National Highway Traffic Safety Administration.  Without the metal body and safety features of a car, a motorcyclist’s primary protection is his or her awareness of the situation, and ability to react to the unexpected.  Each of these incidents leaves behind an entire family with grief over the unexpected loss of a loved one, but also with medical bills and the loss of income from the person they lost.  The devastation that the family may experience will require a great deal of time to cope with, and in many cases the income from the deceased may be irreplaceable, leaving the family in dire financial straits.

No one can replace the void that appears in the life of a family when someone is lost suddenly and unexpectedly.  If you have lost a loved one in a motorcycle wreck, you need someone to protect your financial health and legal interests while you focus on your family during this painful time.  Jason Epstein is a dynamic, compassionate Bellevue motorcycle accident attorney who can work to protect your rights while your family heals from its emotional wounds.  For more information, and a FREE CONSULTATION, contact Jason at Premier Law Group at (206)285-1743.

According to reports Caryl Johnson age 53 of Huntington Beach has filed a lawsuit against the city of Huntington Beach, stemming from a chain reaction accident last year. The accident killed an infant from Australia, while being pushed in a stroller by her mother.

Johnson’s lawsuit filed September 16th in Orange County Superior Court states her car was struck from behind while she was stopped by a distracted driver, causing her vehicle to be pushed into the crosswalk and into the pedestrians.

Johnson claims to have been permanently disabled and suffers emotional scars; her husband is also listed as a plaintiff in the suit and alleges loss of consortium against the defendants. He lists that his wife is unable to perform duties as a spouse, work or services. ?

$25 Million Wrongful Death Lawsuit Filed in Fatal Hazing Incident

$25 Million Wrongful Death Lawsuit Filed in Fatal Hazing Incident

AppId is over the quota
AppId is over the quota
With the school at University of Georgia and other colleges and universities having recently started, your college-bound young adult may be asked to join the Greek System and become part of a fraternity or sorority.

While the Greek system can provide an opportunity to develop future contacts, build a social network at a university and obtain access to a wide range of social and recreational activities, there is also a darker side to the fraternity and sorority experience. Pledge initiation, rituals and hazing that are a frequent part of the fraternity and sorority experience are often portrayed in movies and television as harmless hijinks. However, many times each year college hazing incidents result in serious injury or wrongful death.

Pledge initiation often involves ritual practices like hazing by a fraternity or sorority to bring about a sense of close bonding. Hazing is designed to provide shared experiences frequently under adverse, stressful or physically challenging conditions that promote a tight camaraderie among the members of the organization. While these experiences may be unpleasant or downright painful during the time they are experienced, they theoretically are looked back on by members with humor.

Unfortunately, many times hazing includes dangerous practices such as forced consumption of alcohol that result in catastrophic injuries or even wrongful death. A $25 million wrongful death lawsuit has been filed resulting from the tragic hazing death of a Cornell University sophomore. The mother of the fraternity hazing victim has alleged in her wrongful death lawsuit that fraternity members allegedly blindfolded and bound the hands and feet of her son before kidnapping him. The wrongful death hazing lawsuit also alleges that the fraternity pledge was forced to drink so much that he died of alcohol poisoning.

Although fraternities and sororities are often associated with hazing activities, hazing may be experienced in a wide range of extracurricular activities and clubs. A study entitled the National Study of Student Hazing conducted by professors at the University of Maine found that 55 percent of all college and university students that participate in sports, clubs and organizations experience hazing. While 70 percent of those involved in Greek organizations and varsity sports teams indicated having experienced hazing incidents, these incidents were even reported by members of honors societies (20 percent) and academic clubs (28 percent).

Common hazing practices reported in the University of Maine study include forced alcohol consumption, humiliation, sex acts, sleep deprivation and isolation. Perhaps, the most surprising aspect of these hazing practices is that they are often carried out in public. Students in the study reported that 25 percent of the time an advisor, coach and/or alumni was aware of the hazing incident.

Hazing can lead to permanent life-threatening injuries including alcohol poisoning, serious head injuries, spinal cord injuries, paralysis and wrongful death. When students are forced to consume large quantities of alcohol, subject to physical restraints or deprived of adequate sleep by being woken throughout the night to be forced to submit to acts of humiliation, the results can be tragic. If your child is the victim of hazing and suffers injury or wrongful death, contact the experienced Georgia personal injury lawyers at Montlick and Associates.  We have been fighting for the rights of accident victims throughout Georgia for over 27 years.

As a Seattle car accident lawyer, I unfortunately work with many families that have been torn apart by tragedy.  Obviously, it is never easy to lose a loved one in a car accident, but it is especially traumatic when there are other members of the family present to see the accident.  King5.com reports that on Saturday, a man was killed on US Highway 2 in Snohomish when a wheel flew off a vehicle driving in the opposite direction.  When Rocky Ottow swerved to avoid the loose wheel, he ended up in oncoming traffic and was hit by an SUV traveling the other way, and was killed in the crash.  He had three children in the car with him; one was airlifted to Harborview Medical Center, the other two were unhurt.  Rocky’s father, Lawrence Ottow, was driving in front of his son, and saw the accident in his rearview mirror.  Every fatal accident leaves a family grieving a loved one, but in this case several members of the family actually witnessed the accident.

Every year, over 30,000 people are killed in traffic accidents in the United States, with around 500 of those coming right here in Washington State.  The State Patrol has an initiative commonly referred to as Project Zero, attempting to minimize the number of serious traffic injuries and fatalities with the ultimate goal of eliminating them altogether.  A lofty goal, but certainly a worthy one.  Sadly, for now, there is a long way to go.  OF course, there are things that we all can do to try to help the State Patrol achieve this goal.  The Washington Department of Licensing has a number of resources to help with this goal.

When a family member is lost in a fatal motor vehicle collision in Washington, the most important thing for the family is to work through the grieving process, and focus on the health of the surviving family members.  This is a very difficult process, and sometimes the financial health of the family can be overlooked during this period.  If you have lost a loved one in a Seattle car accident, you need a dedicated, compassionate Snohomish car accident attorney to protect your family’s financial well-being while you look care for you loved ones.  Jason Epstein is an aggressive, experienced lawyer who will fight for your interests.  For more information, and a FREE CONSULTATION, contact Jason at Premier Law Group at (206)285-1743.

A garbage truck traveling northbound on the Sam Rayburn Tollway in The Colony hit and killed a stranded motorist that was trying to cross the highway. The motorist was hit around 6 a.m. after he attempted to cross Highway 121 between Main and Paige Road.

The truck accident caused a traffic nightmare for those driving the tollway as they had to use the highway’s frontage road during morning rush hour.

Unfortunately, stranded motorists are injured or killed all the time in DFW while changing tires, or like in this case, attempting to cross the road. Remember – there is an emergency number on the back of your Texas driver’s license you can call for roadside assistance. If you are stalled on an especially busy road or highway, call the police station and request that a squad car with warning lights wait nearby. These accidents are far too common, but can be avoided – especially if you use the resources available to you.

Seattle Car Accident Attorney | Mother Acquitted After Fatal Accident

As a Seattle car accident attorney, it is all too frequent that my job involves working with a parent who is mourning for the loss of a child.  It is hard to imagine anything more terrible than losing your children in a car accident, but feeling that you might hold responsibility for the accident can only make it that much worse.  KOMOnews.com reports on Wednesday on the case of grieving mother Jayme Davis, who was on the way home from a sporting event in January, 2010 with her two young sons when she drifted across the center line and collided with two oncoming cars, resulting in the death of both of her boys.  Although Ms. Davis had some beer at the game, her blood-alcohol level was below the legal limit; she was nevertheless charged in the boys’ death.  She was acquitted at trial, and reports that for several months after the trial, she was so consumed with grief that she was unable even to leave the house.

Motor Vehicle accidents are the leading cause of death to children in the United States.  The Centers for Disease Control and Prevention (CDC) has some outstanding data on child safety as it pertains to motor vehicles.  The CDC reports that 1314 children at or below the age of fourteen were killed in car crashes in 2009, with many more injuries.  What I find much more disturbing is that they estimate that in one year over 600,000 children went without the use of proper vehicle restraint at least once.  Many of these were right here in Washington State.  The single most important thing that we can do for our children is to be absolutely certain that they are properly secured in their seat, using a safety seat or booster when appropriate, every single time they ride in the car.  They also observe some startling risk factors: a significant majority of children killed in car accidents were with drivers who had been drinking, nearly half of the children riding with drivers who don’t wear a seatbelt go without proper restraint, and almost three quarters of observed child seats were misused, not giving adequate protection in the event of a crash.

Many people believe that losing a child is the most emotionally painful thing a person can experience.  In the awful event that this occurs due to a driver’s negligence in an auto accident, your focus will naturally be on healing the emotional scars of your family.  At this time, you need an experienced Seattle car accident attorney to take care of your family’s legal interests while you concern yourself with more important matters.  Jason Epstein is a veteran, compassionate Seattle car accident lawyer who can look out for the rights of your family during this difficult time.  For more information, and a FREE CONSULTATION, contact Jason at Premier Law Group at (206)285-1743.

Motorcyclists killed during compulsory helmet law protest in fatal crash

Motorcyclists killed during compulsory helmet law protest in fatal crash

Despite the proven record of motorcycle helmets reduce catastrophic head injuries and deaths are many state laws mandate the use of motorcycle helmets still against. The compulsory helmet law generally against have objections based on individual freedom.

Unfortunately sometimes, individual freedom comes at a high cost. Was a motorcycle enthusiast in New York, a bike ride to protest, mandatory helmet laws was killed when he crashed and suffered serious head injuries involved.

The debate on the mandatory motorcycle helmet laws pits typically public safety advocates against those that the laws as a paternalistic intrusion on their personal choice display. All motorcycle riders are required by State law for motorcycle helmets in 20 States including Georgia wear, and 27 other States make compulsory helmets based on age of the driver.

There is little dispute, motorcycle accidents usually far more serious injuries and a higher probability of wrongful death than those with car. Administration (NHTSA) is based on data from the national highway traffic safety the accident mortality rate for motorcyclists 550 percent greater than for passenger vehicle occupants per registered vehicle. Based on other information from the NHTSA, motorcycle accidents account for approximately 14%, although they registered only 3 percent of all vehicles at the national level all the deaths of make.

While there are a number of motorcycle enthusiasts to oppose the mandatory helmet laws, it is a fairly significant body of proof, the helmets save lives and reduce catastrophic head injuries in motorcycle crashes. The NHTSA estimates that motorcycle helmets per year save nearly 2,000 lives and predict if all motorcycle riders wore helmets a further 800 motorcycle accident deaths per year would be prevented. These numbers are hardly surprising when you consider that more than 40 percent of all drivers in motorcycle accidents killed bear no helmet.

Regardless of which side of the debate, it comes down, it is also difficult to argue that the costs borne by no motorcycle helmet is significant. NHTSA data indicate mandatory helmet saves about $3 billion per year and this universal use in one would result in another $1.2 billion in savings.

Those mandatory helmet against criticizing laws produced the data from the NHTSA, because the organization advocated compulsory universal use of motorcycle helmets. Critics of mandatory helmet laws argue that it less motorcyclists since the adoption of mandatory helmet laws but that it no significant decline in the motorcycle accident fatalities. Laws against those the compulsory helmet also claim that there is no problem of public health since the motorcycle accident victim of their own health care costs will have to pay. However, this takes into account not for the drain on resources for public health with anyone who receives any form of publicly subsidized health care.

Montlick and Associates, we believe in public safety and preventable tragedies to prevent. Unfortunately, we see many people the catastrophic life-changing injuries and wrongful death fatal to suffer from motorcycle accidents in Atlanta and very Georgia.
