Warning all drivers: cell phone crackdown happening in San Diego County
AppId is over the quota
For your own safety, cell phone use while operating a motor vehicle is illegal in the state of California. This includes calling, dialing, or texting using a cell phone device.
Why? According to the National Highway Traffic Safety Administration, 80 percent of car accidents involve at some form of driver distraction within three seconds of the car crash, and talking on a cell phone is one of the prime distractions leading to car accidents today.
Did you know that dialing a phone number on a cell phone while driving increases your risk of a car accident or near car accident 2.8 times?
That’s why it’s no surprise that authorities in the San Diego County area are cracking down on cell phone use while driving. This month, police in San Diego unrolled their zero-tolerance campaign against using cell phones while driving, according to CBS News.
But it seems that San Diegans just can’t put down the cell phone when driving. Call it a bad habit or just plain irresponsible, but cell phone use while driving is no light matter. On Dec. 10, some 456 people were ticketed for illegally using a cell phone while driving within San Diego County.
If you need further proof that cell phone use while driving is dangerous, consider a study conducted by The Journal of the Human Factors and Ergonomics Society which suggested distracted drivers who use cell phones are just as dangerous on the road as those driving under the influence, according to CNET News.
The study set up four different driving scenes. Forty drivers were evenly allocated into the following four driving conditions: no distractions, using a handheld cell phone, talking on a hands-free device, and driving while intoxicated to the California legal limit of .08 percent blood alcohol level. The participants followed a pace car in each unique condition. The pace vehicle simulated real-life conditions like stop-and-go traffic and intermittent braking.
At the end of the simulation, researchers found that drivers using mobile devices while driving drove slower, braked slower, and were more likely to have a distracted driving car accident than other drivers in other simulations. In fact, not even one of the drunk drivers crashed, but three participants using cell phones were involved in a car accident.
San Diego, please put down the cell phones – it’s never been more important to stay safe on the roads and avoid car accidents and personal injury. You can do your part by not using your cell phone while driving.
If a car accident injury does occur from another driver’s cell phone use, contact our San Diego auto accident lawyers at 1-800-655-6585 for a free and private evaluation of your case.

DeKalb County Reportedly Considering Repealing Ban on Pit Bulls
AppId is over the quota
There is wide disagreement regarding whether pit bulls are inherently dangerous and unsafe animals, or whether they are simple scapegoats for irresponsible dog owners. What is not deniable is that during a five year period from 2004-2009 someone was killed in a pit bull attack approximately every 22 days according to Dogbite.org.
Despite laws regulating pit bulls in over five hundred cities, pit bull attacks accounted for almost half of all dog attack fatalities in 2009. Although the reasons that pit bulls are far more likely than other breeds to be involved in Georgia dog attacks is a point of contention, it is clear that pit bulls continue to pose a threat of disfigurement, catastrophic injury and wrongful death.
Nonetheless, the laws regarding pit bull restrictions are unsettled in Georgia. While Georgia attempted to make pit bulls illegal on a statewide basis as recently as 2005, the proposed legislation failed. DeKalb County, which is currently the only county in Georgia that prohibits pit bulls, is considering repealing its decades old ban on pit bulls according to an article in The Atlanta Journal-Constitution this weekend. The repeal would be part of a broader overhaul of DeKalb County’s animal services department.
Those supporting the repeal argue that there are other dangerous dogs so the approach to preventing Georgia dog attacks should focus on specific unsafe dogs and dog owner’s who do not properly train, control and supervise their dog. This is particularly the case with dog owners that know their dog has a vicious propensity based on past behavior. It is also argued that many pit bulls that cause the DeKalb County euthanasia rate to rise pass a temperament test to be adopted but cannot be adopted out because it is believed that that they are a pit bull.
While Georgia pit bull attacks may be a function of owners who fail to take adequate precautions to protect others from vicious dogs including owners who train their dog to be aggressive, there are inherent traits that make pit bulls more likely to maul or attack a victim. Pit bulls have specific genetic traits that distinguish them including tenacity (refusal to give up without a fight), unpredictable aggressiveness, extreme tolerance for pain as well as a distinctive bite and shake style of attack. While it is true that training and other environmental factors can have a significant impact on the viciousness of a pit bull, courts have recognized these inherent characteristics of pit bulls. Pit bull attacks have been compared in uniqueness to shark attacks based on forensic medical studies.
Another characteristic of pit bull attacks that distinguishes them from other dog attacks is a high propensity to attack their owner and other family members. A study by the Humane Society of the United States (HSUS) found that out of 143 pit bull attacks, 19 (13.3%) involved attacks on the owners whereas only 3 (2.2%) involved the owner when compared to a similar number of the dog attacks involving other breeds. This phenomenon known as the Pit Disloyalty Phenomenon (PDP) was recognized over two decades ago by HSUS publication.
It is unclear at this point whether the law banning ownership of pit bulls in DeKalb County will be repealed, but there is little question that pit bull attacks cause horrific and debilitating injuries and wrongful death. Fatal Carroll County Bus Driver Was Sleepy from Taking Cough Syrup
AppId is over the quota
The issue of sleepy drivers is a matter of great concern that can cause Georgia auto accidents that result in serious injury or wrongful death.
Many people take medications, whether prescription medications or over-the-counter drugs, that can either make a driver sleepy or exacerbate the effects of driver fatigue. We wrote recently that a school bus driver trainee that was involved a fatal school bus accident entered into a plea agreement that resulted in probation.
A media report indicated that the school bus driver may have been sleepy because he was under the influence of cough syrup. It has been widely reported that the driver had run over a dog earlier in the day and was observed struggling to keep the bus in its lane of traffic. A trainer was onboard and apparently observed all of this activity and noted it but did not intervene. The bus driver’s toxicology screening was negative for illegal drugs and alcohol but was positive for brompheniramine, an ingredient used in cough medication that can cause sleepiness and fatigue.
These tragic new details only add to the sad reality that this was an easily avoidable tragedy. When an employer or a supervisor for an employer has knowledge that an employee is not fit to operate a vehicle, the employer may be liable for injuries or wrongful death resulting from a collision involving a driver who is negligently entrusted with a motor vehicle. An employer should never entrust an employee who is not fit to drive with a car, truck or SUV, and especially a commercial driver like a bus driver or tractor-trailer driver who is sleepy, ill or taking medications that impair driving ability. The information that the driver in the fatal Carroll County school bus accident was sleepy because he had taken cough syrup only adds to the growing body of evidence of negligence on the part of the trainer and the school district.
Sleepy driving is a problem that most people recognize as unacceptable and dangerous but engage in despite the risk of causing a serious Atlanta car crash. According to the Insurance Networking News, 85 percent of drivers identify sleepy driving as an unacceptable driving practice. Despite this widespread view, 41 percent of drivers admit to having fallen asleep behind the wheel at some point based on data from AAA. Anyone driving when they are tired faces a serious risk of being involved in a sleepy driving accident. The risk is not only that drivers may be injured in sleepy driving accidents but that there also is an extremely high risk of sleepy driver accidents resulting in fatalities. Tired drivers account for over 16 percent of all auto accident fatalities according to the National Highway Traffic Safety Administration (NHTSA).
If you are tired either because of illness, side effects of medication or lack of sleep, it is important to stay off Atlanta roadways to avoid fatigued auto accidents. The experienced auto accident attorneys at Montlick and Associates, Attorneys at Law, recognize that tired drivers pose a serious danger of causing drowsy driving accidents in Atlanta and throughout Georgia.
If you are injured by a tired driver in a crash caused by driver fatigue or a driver who falls asleep at the wheel, our experienced Atlanta personal injury lawyers have been representing victims of fatigued drivers for nearly 30 years. Our Atlanta accident lawyers are available to assist clients throughout all of Georgia and the Southeast, including but not limited to Albany, Athens, Atlanta, Augusta, Columbus, Gainesville, Macon, Marietta, Rome, Roswell, Savannah, Smyrna, Valdosta, Warner Robins and all smaller cities and rural areas in the state. As Seattle personal injury attorney, I know that they are relatively rare compared to road accidents, disastrous accidents can have bus for their victims. The Seattle Times reported on Tuesday about a bus accident, which occurred in 2006, and for which a man has filed suit against King County. Sometimes, when people in accidents with government authorities are injured, they believe that to protect them no power or rights. Although we think bus accidents as rare, they happen. The Federal Motor Carrier Safety Administration reported 55,000 bus crashes every year throughout the country and in Washington State, leading to more than 20,000 and more than 250 accidents. These numbers are certainly much smaller than the one that crashes in General apply to traffic, but they are still very significant numbers, and a number of them happen here in Seattle. Recent Auto-Bicycle Accident Turns Deadly in Cook County
AppId is over the quota
Bicycling in your neighborhood or to work should be an enjoyable, stress-free activity. But for a man in Cook County, Illinois, and for thousands of other bike riders, careless or negligent drivers can cause a serious injury or death. In late July, a 79-year-old man was cycling two blocks from his home in suburban Maywood when he was hit by an automobile shortly after 8 p.m. Within an hour he passed away at Loyola University Medical Center.
According to BIKESAFE, most automobile-bicycle accidents occur in the summer months of June, July, and August between 5 and 9 p.m. Through its case studies, BIKESAFE, in conjunction with the U.S. Department of Transportation, found that auto-bicycle accidents are most often caused by a driver who:
fails to yield at an intersection light
fails to yield at a stop sign
drives out mid-block or mid-driveway
turns left or right into a bicycle path
tries to overtake a bicycle
An estimated 53,000 injuries occur every year from auto-bicycle accidents and two percent of them are fatal. Cyclists must be mindful to wear helmets, obey traffic laws, and be aware of vehicles around them. In urban areas in and around Chicago, cyclists also have to be cautious with drivers going high speeds. Poor sight distance, speeds that make it harder to brake quickly, and traffic jams can increase the chances of an accident. Injuries can also occur when bicycles ride next to parked vehicles and a door is opened unexpectedly. And in the case of the Cook County senior, riding at dusk and into the night hours can cause visibility problems. Cyclists should be sure to use rear reflectors, pulsing lights, and other bright gear when they ride at night.
Automobile-bicycle accidents can cause serious brain injuries, even when cyclists are struck by vehicles going 35 mph or less. Back and limb injuries are also very common. When an accident like this occurs, the driver’s car insurance is responsible for your medical expenses. The Chicago bicycle accident lawyers at Briskman Briskman & Greenberg have helped many accident victims recover compensation for their medical bills, pain and suffering, future care, and lost wages. They are also experienced in guiding loved ones in a wrongful death lawsuit.
