Insurance Company's Defamation and Copyright Suit Against Blogger Thrown Out

A recent suit filed by Sedgwick Claims Management Services against blogger Robert Delsman has been thrown out by Northern California District Judge.
The blogger actually represented himself in this case and filed the motion that the court construed as a motion to dismiss. While it wasn't exactly eloquent or artful it did the trick and showed that Sedgwick was using the lawsuit to intimidate him and infringe on his freedom of speech. A California law, known as the SLAPP Act, protects citizens from intimidation through litigation brought by private interests.

Greetings!
This blogs previous author, Ben Buchwalter, has moved on to Law School (congrats, Ben!) which means it’s time for a new voice in this space—mine! I’m very excited to get cracking here with GJEL. I wasn’t sure quite what to expect when I joined up with this firm, but I’ve been totally blown away by the quality of the people here and the work they do.
As you probably know, GJEL is a impressively decorated firm with a history of excellent performance on its clients’ behalf. You may not be aware that it’s staffed with the kind of people who you’d not only want to represent you in a court room, but also meet with for a friendly lunch.
My writing background comes primarily from own blog, HoopSpeak, which is an ESPN affiliate NBA blog. I was an English major at the University of Pennsylvania, and enjoy the chance to write daily in this space. I’m looking forward to continuing the great work Ben did for nearly two years, and to adding my own personal touch to the GJEL blog.

Insurance company thrown libel and copyright lawsuit against blogger
The blogger actually even in this case represented and filed the motion, that the Court as a motion to dismiss, designed. While it does not exactly eloquent or elaborate it did the trick and showed that Sedgwick lawsuit was used to intimidate him and violate his right to freedom of expression. A California law known protects citizens as the Act SLAPP'ED intimidation through litigation by private interests brought.

Didlake, Inc. asks lawyer blogger factual post on action remove
Die Blogging-Welt werden dies zu schätzen wissen.
Unsere Firma behandelt ein Verfahren gegen eine lokale Firma, die für Behinderte Erwachsene kümmert. Wie auch immer, mehrere Blogger aufgegriffen unserer Pressemitteilung und Blogs und natürlich, es ist eine Gericht Meinung über den Fall. Stellungnahme der ist günstig für Didlake.

Didlake, Inc. asks lawyer blogger factual post on action remove
Our company deals with a case against a local company who care for disabled adults. We claimed that the negligence of the staff of Didlake, Inc. a disabled adult, Serialisierungslogik surgery for the installation of a titanium Rod severe injuries in his leg caused. Didlake denied the claim, denied it was responsible and was entitled, could be sued not because it was a "non-profit organization" charitable immunity.
The Court ruled that Didlake was right, that this severely disabled adults could not sue.
We took the matter to the Supreme Court of Virginia, and lost. We were in Didlake's assertion, as multi-million-dollar organization, issue, that it's on "Charitable immunity was claim."
Didlake won the Argumemt and full credit for them to claim the award-winning argument of this time.
The case is important, however. Charitable immunity is we believe that a relic from the dark ages, especially in a world of insurance (with Didlake) and the fact that the charitable immunity doctrine singles from only those who get the benefit of the charitable organization, and makes it the sacrificial Chamber lambs in the interest of something as bad defined and nebulous as "public interest".
As well, several bloggers picked up our press release and blogs and, of course, it is a court opinion on the case. Opinion is favourable for Didlake.
So its only very interesting, that Didlake is trying to convince down factual, truthful, blogs bloggers to take.
