The FMCSA and the trucking industry knows how dangerous sleep apnea is for a truck driver. The FMCSA states HERE that: 

Staying awake means staying alive. Sleep apnea is a major contributor to daytime drowsiness—a condition that could prove deadly for commercial truck drivers and everyone sharing the road with them. It is a condition where, during sleep, a narrowing or closure of the upper airway causes repeated sleep disturbances leading to poor sleep quality and excessive daytime sleepiness. Since excessive sleepiness can impact a driver’s ability to safely operate the commercial vehicle, it is important that drivers with sleep apnea are aware of the warning signs.

The research arm of the American Trucking Association (ATA), American Transportation Research Institute (ATRI), states that sleep apnea exists in almost 1/3 of commercial driver and contributes to wrecks. See the white paper HERE.

The FCC just announced Monday that texting services will be added to the 911 emergency lineup. The government agency decided to add texting services as part of their emergency response system since 70 percent of 911 calls are derived from mobile devices. Now, individuals facing an emergency will be able to relay help to dispatchers using text services, according to ABC News. But how will texting 911 mix with texting and driving laws in California?

FCC chairman Julius Genachowski has committed to modernize FCC protocol, calling it the Next-Generation 911 service. “911 is an indispensable, live-saving tool,” Genachowski said. “But today’s 911 system doesn’t support the communication tools of tomorrow. Even though mobile phones are the device of choice for most 911 callers, and we primarily use our phones to text, right now, you can’t text 911.”

The pros of the Next-Generation 911 service will allow individuals to communicate with emergency service in situations where they are unable to speak. This will be useful in an emergency car accident if an individual is faced with some sort of technical difficulty: no signal, low battery, or poor service.

However, an overlooked con to texting emergency services is the possible distraction it can impose on those already driving, especially if they are in a perilous situation. Distracted driving laws in California including cell phone use and text messaging have been strict, and for good reason.

According to the National Highway Traffic Safety Administration, dialing a cell phone increases the risk of a car accident or near car accident 2.8 times. This blog often champions causes that prevent drivers’ attentions from leaving the immediate concerns of the road. Drunk driving and distracted driving (typically in the form of texting or cell phone use) are frequent targets. But we don’t often enough consider the dangers of falling asleep at the wheel. That’s too bad, because unlike drunk driving and distracted driving, two problems for which immediate technological solutions seem distant, driver wakefulness appears to be a readily addressable danger.

This issue is receiving renewed attention as a part of Drowsy Driving Prevention Week (sponsored by the National Sleep Foundation). AAA recently released a study which indicates that like distracted driving, though drowsy driving is a widely acknowledged danger, a disturbing number of people self-reported driving drowsy.

Although 96 percent of drivers said drowsy driving is unacceptable, nearly a third admitted to doing so in the past month. Further, the National Sleep Foundation’s 2011 Sleep in America poll found that nearly one in ten 16-45 year old drivers report driving drowsy once or twice a week.

Driving while fighting sleep invites a particularly frightening scenario in which a 1,500 hunk of steel is being completely unmanned. AAA estimates that nearly one in six traffic fatalities and one in eight accidents that result in injuries requiring hospitalization involve a drowsy driver.

David Cloud, CEO of the National Sleep Foundation, provides this aptly terrifying image: “Many don’t realize that driving while drowsy is very dangerous. If you’re so tired that you can hardly keep your eyes open, you could fall asleep for just a few seconds and not realize it. If that happens at 65 miles an hour, you could drive the length of a football field in an unconscious state.”

AAA offers the following advice: Get plenty of sleep in advance of road trips, take regular (2 hour) breaks, make liberal use of caffeine if necessary, and bring someone who can keep you company (and awake).

All great, common sense pieces of advice, but sometimes common sense just isn’t enough to control human behavior. It’s a concept implicit in our terming of auto-collisions as “accidents.” If we acknowledge that humans are prone to error, we should do something systemically to mitigate those dangerous faults.

Fortunately, technological advances and their increasingly widespread application may hold a simple solution. Beginning around 2006, driver monitoring systems that track drifting between lanes and driver eye movement have been developed to rouse drivers when they exhibit signs of sleepiness.

Lexus, Mercedes, Volvo, GM, BMW, Hyundai, Renault Trucks and many others all employ some form of the safety systems. In addition to being a feature in many new cars and an aftermarket safety enhancement, researchers are working to ascertain the effectiveness of driver monitoring technology in truckers, a demographic disproportionately exposed to the risks of drowsy driving.

While some drivers may object to intrusive systems that provide unnecessary alerts, laser optic technology that senses proximity to and approaching speed of other vehicles certainly has the potential to greatly reduce accidents that come in a moment of distraction, or drowsiness. There are also concerns about the cost of the system, despite evidence illustrating the dangers of sleepy drivers. A 2009 government study (of trucking systems) addressed those issues, and found that even from a purely economic standpoint, the yearly cost of crashes would decrease in amounts more than sufficient to cover the cost of the technology.

Our understanding of the benefits of driver and vehicle monitoring systems increases and the cost of the technology is decreasing. Hopefully, we’ll soon be able to put drowsy driving concerns to bed.

Aluminum bats have long been a standard piece of sports equipment in Atlanta high schools and little league baseball leagues throughout Georgia. The bats are lighter than wooden bats making it easier for high school athletes to hit home runs.

However, these metal bats can act like a trampoline when the ball comes off the bat, and cause catastrophic head injuries to players in the field. A baseball can travel at speeds in excess of 130 mph when it comes off of a metal bat and cause permanent catastrophic head injuries when the baseball strikes a player in the head, which can lead to permanent impairment of mental functioning including loss of communication ability, sensation and cognitive skills.

Some states have considered the issue of banning metal bats because of the risk of serious injury. The problem with metal bats is that the ball comes off a metal bat at higher rates of speed than a wooden bat. Metal bats used in Georgia youth baseball leagues can tragically cause fatal injuries as well as catastrophic head injuries, including leaving a baseball player in youth and high school leagues in a persistent vegetative state.

The manufacturer of a metal bat can be liable for injuries that result from failing to provide adequate warnings regarding the potential dangers. An example is a verdict of $850,000 awarded to a family of a high school boy in a Montana case against Louisville Slugger for failure to warn of the increased velocity associated with the metal bat. The boy was pitching and had no chance to react because of the speed the ball was traveling when hit. Reports indicate that the ball struck the boy in the head and was propelled as far as fifty feet in the air after striking the boy in the head. The boy immediately suffered seizures and died later that day.

There has been an increasing push to ban metal bats in youth leagues in response to incidents like these. Some sports leagues have taken it upon themselves to ban the metal bats to avoid such tragic injury. These tragic accidents are all the more heartbreaking because the only reason to use the metal bats instead of wooden bats is to hit more home runs. A higher number of home runs would seem a very high price to pay for an increased risk of traumatic head injuries and fatalities.

Many metal bats are exceedingly springy composite bats that literally function as a trampoline launching the ball. At the very least, metal bats should be limited to conform to specifications that approximate wood models and/or carry clear warnings of the risk posed from the increased speed of baseballs hit by metal bats. It also is worth noting that many children in youth leagues may not appreciate the nature of the increased risk even with a warning.
