Governor Haslam has signed a law that states that non-economic damages should be capped in injury (tort) cases In Tennessee at $750,000 in most cases. Now in Tennessee juries are trusted to sentence a man to death, but apparently they are not trusted by the Governor to determine the proper amount of compensation for victims of someone else's wrongdoing in an injury case. There is not even a "three strikes and you're out" rule for really bad people and corporations that are repeat offenders!
Whether you agree or disagree with jury limits doesn't really matter, as the Tennessee Legislature and Governor Haslam can pass whatever legislation they want, and apparently they wanted to limit the amount of non-economic damages that can be received from someone injured by a wrongdoer. The new law is flawed in several aspects in my opinion.
First there is the hypocrisy in allowing "unlimited" damages against those that commit intentional acts. That sounds great but the Governor and legislators know that NO INSURANCE POLICY IN TENNESSEE WILL PAY FOR AN INTENTIONAL ACT. It is EXCLUDED from the policy. Thus an an injured victim will likely get less money, not more, if you prove the defendant acted intentionally. It sounds good on a stump speech, but in reality this section of the law gives nothing and takes away everything form the injured. The Governor could have easily required insurance companies to cover these acts, but chose not to do so.
The second level of the legislature's and Governor's hypocrisy is that juror's WONT BE TOLD that there are limits in place. They believe that they helped someone, when in reality the government took it away and made them sweat out determining the amount of non-economic damages above $750,000 in the jury room for NO PURPOSE.
The final part of this tragedy is that the Governor will allow some catastrophically injured Tennesseans to receive more than others. There is a special category for "catastrophic loss," which would raise the cap for non-economic damages in cases involving serious spinal cord injuries, severe burns, some severe multiple amputations, or the death of a parent of minor children. Now this new law excludes parents of adult special needs children, children taking care of the elderly (don't worry, they can go to a state run nursing home), victims with brain injuries, twenty year olds who have to wear diapers, or a bag, to catch excrement and waste fluids, chronic pain, etc...
Shouldn't we let a jury, on a case by case basis, decide if these cases are catastrophic after hearing the all facts? Shouldn't we let a jury decide that if you kill enough Tennesseans, you are going to get put out of business? Do parents taking care of special needs adult children, really deserve less than parents taking care of minor children? The Governor and legislature chose to take away these choices from the jury. Some Tennesseans are now more different than others and none of us are as special as corporations.
Many of my clients are brain injured, and catastrophically so, even if they are able to walk and talk. Their lives, as they knew them prior to the wreck, are over. In many case their personalities have changed. They died, but their life goes on. I find it arbitrary, and frankly an abuse of power, that the Governor has decided who can be catastrophically injured in advance of knowing all the facts. That Nashville knows better than a jury of 12 Tennesseans. I guess I trust the people of Tennessee more than those in office now. Voter's of Tennessee, your governor and your legislature just called you too stupid to do what is right in a jury box. (they also called the Judge, lawyers in the case, the Courts of Appeal and the Tennessee Supreme Court too stupid to get it as well, but hey, they were on a roll.) Voters you need to remember this come November.

November 2, 2011 - According to reports a police officer was injured when hit by a driver he pulled over for a traffic violation. According to Garden Grove Police Department the police officer was injured in the 13000 block of Brookhurst Street in Garden Grove at approximately 9:33 a.m. Wednesday morning.
Garden Grove Police Lt. Jeff Nightengale stated that the motorcycle officer stopped the driver for not having his seatbelt on, who then fled from a parking lot where he had pulled over. The motorcycle officer was struck by the vehicle suffering injuries to the legs.
According to Lt. Nightengale the officer is expected to recover, but he was unsure of the extent of the motorcycle officer’s injuries. The Garden Grove police have identified the driver as 28 year old Marcos Gonzalez, who is described as 5 feet, eight inches tall and approximately 220 pounds. At the time that the motorcycle officer was struck the vehicle was a 2002 four door green Infiniti, according to police.
According to Lt. Nightengale the information about the driver and the vehicle was obtained from the ticket the police officer was writing at the time he was struck. Police have not found any outstanding warrants on the driver.
Lt. Nightengale said the officer noticed that the driver appeared to be acting nervous, at which time the officer asked the man to step outside of the vehicle and patted him down. The officer radioed for backup and the man ran back to the car. The officer and the man struggled at the door of the vehicle, when the driver put the car in reverse knocking the officer down with the open door. The driver then put the vehicle in drive and drove over the officers legs.

Two people injured in five-vehicle crash on the I-405 freeway

Hollywood Freeway multi-vehicle crash kills one person and critically injured another person
October 15, 2011 - report that one person was killed and another critically injured, a Boeing in collision in Hollywood Freeway.

Three Dead, Two Injured in Early-Morning Arlington Wreck

It’s only Monday morning, and already a disastrous single-car accident which occurred in Arlington in the early hours has cost three people their lives and left another two hospitalized in critical condition. At approximately 3:00am this morning, an Arlington patrol officer witnessed a flash of light on Southeast Green Oaks Boulevard between Cravens Park Drive and Yaupon Drive. A Honda Accord carrying four passengers in addition to the driver crashed into a tree. No other vehicles were involved in the collision.
According to the police, the driver and a passenger identified as his brother were pronounced deceased at the wreck scene. A third person, a female, died shortly thereafter at John Peter Smith Hospital in Fort Worth. Another two individuals, both passengers in the car, remain in critical condition and are being treated for serious injuries. No names of the accident victims have been released, although police have confirmed the ages of all five individuals range from 17 to 21.
At this stage, a police investigation has not determined what caused the driver of the Honda to lose control, although it is believed that speeding was a factor. Given the rain we’ve had over the weekend after a month-long drought, the roads around DFW are particularly slippery right now, causing hazards for all motorists. Police also reported that a liquor bottle was recovered from the destroyed vehicle, and have noted that alcohol could possibly have been a factor although they cannot confirm whether the driver had indeed been drinking.
Regardless of the causes of this crash, the fact that it is a tragedy is undeniable. I would like to offer my most sincere and heartfelt sympathies to the families and loved ones of those whose lives were lost in the accident. I am very sorry for your loss. I would also like to offer my thoughts and hopes for a full recovery to those who remain under the doctors’ care.

Collision Causes Rollover and One Person to be Injured

October 8, 2011 - According to reports a Saturday morning collision caused one person to be injured and a vehicle to rollover. According to the California Highway Patrol the accident occurred at approximately 4:23 a.m. in the northbound lanes of the 55 Freeway, in the vicinity of the 405 interchange.
The motor vehicle accident according to California Highway Patrol spokesman Mike Corcoran the two car collision resulted in one car to crash into a tree and the other vehicle to rollover. Woman Killed, Six Others Injured In Grand Prairie Wreck

Most of us don’t even think about how dangerous it is to get in the car and head out somewhere. We just don’t think about it. We do it every day, and yet we rarely stop to think that we’re really putting our lives at risk every time we are either a passenger or a driver on the roads of Dallas-Fort Worth. As a North Texas personal injury lawyer, I know that deadly wrecks happen throughout DFW on a daily basis. Some are caused by drunk drivers, but not every crash is the cause of such gross negligence.

On Saturday afternoon, for example, Juana Mancilla, 71, of Grand Prairie, was killed in a fatal two-vehicle accident at the intersection of Dickey Road and Texas 161 in Grand Prairie. Mancilla was a passenger in an SUV which allegedly ran a stop sign putting in the path of a van which hit its side. According to police, Mancilla was ejected from the SUV which then rolled over, landing on top of her. She was pronounced dead at the scene.
Both the driver of the SUV, Jose Cruz Mancilla, 41, and the driver of the van, Billy Bannister, 71, as well with four additional passengers in the SUV were taken to hospital by ambulance to be treated with what were described as non-life threatening injuries.
I don’t want to speculate on the cause of this terrible accident, since clearly as a passenger in the SUV, Mrs. Mancilla had no control over the vehicle she was riding in at the time of the collision. Naturally, my thoughts and sympathies go out to all those who were hurt in the wreck, as well as their loved ones.
Unfortunately, while it does not appear that there was any significant negligence prior to this accident taking place, it goes to show just how suddenly and without warning an auto accident can occur. We should all realize that getting behind the wheel is the most dangerous thing we do every single day. And we should all resolve to take much greater care while driving around DFW.

At around 3:15 p.m. on September 13th, a vehicle crashed right into McCaffrey’s Market in the Princeton Shopping Center on North Harrison Street in Princeton, New Jersey. The car accident injured two shoppers in its path after barreling into the local grocery store, causing some damage to the structure of the building. David Isaacs of Hillsborough, the driver of the vehicle in question, was also injured in the accident, having to be removed from his vehicle by the Princeton First Aid Squad after being trapped inside. Huntington Beach Infant, Toddler and Father Injured In Crosswalk by Motorist

September 27, 2011 - According to reports a father, infant and toddler were injured at a Huntington Beach crosswalk by a motorist on Monday afternoon.
According to Huntington Beach Fire Department Deputy Fire Marshal Jeff Lopez, the accident occurred at approximately 4:30 p.m. at Central Park Drive and Edwards Street.
Huntington Beach Police Department Lt. Mike Reynolds said that investigators believe the man and two children were struck while in the crosswalk, by a motorist making a left hand turn onto the northbound lane of Edwards Street.
Lt. Reynolds stated the accident occurred at a four way stop, where the driver is believed not to have seen the pedestrians crossing from east to west on Edwards Street.
The father was holding a one year old at the time they were struck and a three year old was on a tricycle, Lt. Reynolds said. The father and one year old rolled over the hood of the vehicle sustaining minor injuries, including bruises.
The vehicle reached the top of the tricycle injuring the three year old that was wearing a helmet at the time of the incident, according to Lt. Reynolds. Huntington Beach Police stated that a helicopter was placed on standby, but was later canceled. The father and two children were transported to UCI Medical Center by ambulance for treatment of their injuries.

Two Injured in Anaheim Head On Crash

September 19, 2011-According to reports an early morning head on collision injured two people in Anaheim.
According to the Anaheim Police Department the head-on collision was reported at approximately 7:29 a.m. in the vicinity of the 930 North Magnolia Avenue.
The two vehicle collision involved an Acura Legend and a Mazda MPV, with the Acura traveling southbound and the Mazda northbound. According to the MetroNet dispatcher one of the people involved in the collision was transported to UCI Medical Center and another injured victim was transported to Anaheim Regional Medical Center.
Anaheim police at the scene of the crash stated that the male driver of the Acura was attempting to make a left turn onto Greenbrier Avenue, when the head-on collision occurred. All of both the north and southbound lanes of Magnolia Avenue were blocked until the damaged vehicles were removed from the scene of the crash and emergency vehicles cleared the scene.
