Allstate Insurance Company must pay a Louisiana man who lost his home to Hurricane Katrina more than $2.8 million in damages and penalties, a federal jury decided Monday in a case that hinged largely on whether it was wind or storm surge that wiped out his house.

The jury found Allstate – which claimed most of the damage was due to storm surge, an event not covered in its policy – did not pay Robert Weiss enough money to cover wind damage to his home. The verdict included a $1.5 million penalty for the company’s failure to pay the claim quickly enough.

Allstate lawyer Judy Barrasso said in closing arguments that Katrina’s winds were not strong enough to do the damage.

The lawyer for the Weiss, whose home was in the Slidell area on the north shore of Lake Pontchartrain, told the jury in closing arguments that the house was too high above sea level to have been destroyed by Katrina’s storm surge. The eye of Katrina passed just east of Slidell on the morning of Aug. 29, 2005. He also argued that the house was 17 feet above sea level and that engineering data suggested only 14 feet of surge hit the area. “It never reached the bottom of the house,” he said.

Weiss had an Allstate homeowner policy with limits of $343,000 for the dwelling and $240,100 for personal property.

The company, blaming the majority of damage on Katrina’s storm surge, paid $29,483 for structural damage and $14,787 for additional living expenses.

Allstate’s Barrasso said sustained winds at the house did not exceed 100 mph. “There was plenty of evidence to show the winds were not strong enough to topple this house and the storm surge was,” she said.

Jim Neva, a surveyor and engineer who inspected the house for Allstate, initially told Robert Weiss, who is listed as the policy holder, that wind may have destroyed the home before the surge of water washed away its remnants.

He later backed off that conclusion, however, and deferred to engineering consultant Craig Rogers of Rimkus Consulting Group. Rogers, who wrote the final report on the home for Allstate, convinced Neva that storm surge demolished the house.

Rogers said he didn’t personally inspect the property until after he wrote the report. He said he based his conclusions in part on evidence gathered by other Rimkus engineers – a practice he described as common. But Trahant questioned the move.

“Why did Allstate elect to rely on the one engineer who never set foot on the property until long after he stamped his report?” Trahant said in closing arguments.

The Supreme Court of Virginia has ruled that a mother who hosted a teen age girl for a sleepover, and who made a promise to the parents that "I won't let you daughter be driven by a boy" may be sued when the young girl died in an accident later that night when being driven by a teen age male driver.

This case should send a strong warning to parents that they have an obligation to keep their promises.

The tournaments leading up to the Little League World Series have been happening all summer and the actual 16-team tournament kicks off in about 11 days. I really enjoy watching the LLWS and I'd hate to see it go which is why I'm so concerned by the latest legal news involving Little League Baseball Incorporated in which they settled a case for $125,000 up in Staten Island, NY.

The injury? Some ligament damage that a 12-year old suffered from sliding into second base. The family sued almost three years after the fact on the grounds that the coach was negligent in not teaching the kid proper sliding technique. Absolutely ridiculous. If a coach lets a kid take batting practice without a helmet then I can see a problem and certainly some negligence, but proper sliding technique? C'mon!

If coaches are going to get sued every time a player gets injured then who in their right mind is going to coach? It's hard enough as it is to get parents to take the time to coach these teams add in financial risk and watch the pool of potentials dry up.

By playing sports you assume some risk of injury, it happens. Even star athletes using perfected techniques end up injured. So why did Little League Incorporated settle? It seems like they're trying to keep that under wraps but they're only hurting themselves. If Little League Baseball Inc. doesn't fess up to why they settled such a weak case it's only going to hurt them in the long run and encourage others to file frivolous suits which can only end up causing fewer coaches, fewer teams, and less opportunities for kids to play a great game in a great environment. Your move Little League.

The family of a Maryland man has hired legal representation and filed the fifth lawsuit Thursday, against Jensen Farms and Frontera Produce, which are the cantaloupe producers and distributor of the Rocky Ford Melons. The lawsuit was filed in the U.S. District Court in Maryland by the family of a Maryland man that died after eating one of the contaminated melons.

The legal claim # 1:11-CV-2810, states that Clarence Wells consumed cantaloupe on more than one occasion, prior to becoming ill. Wells had symptoms of Listeria infection, including fluid retention, August 23, 2011 and by August 25th, he has gained another nine pounds. By the August 25th date Wells was having difficulty breathing and was taken to the hospital emergency room.

Then Mr. Wells was admitted to John Hopkins Medical Center, where Wells condition deteriorated on the morning of August 31st. His family was alerted and found Mr. Wells unconscious and later that evening he died, without his family being able to speak to him.

According to the Wells family attorney the loss the family has suffered is tragic and is not the only one with the Listeria outbreak. The attorney also stated that three other families are being represented by their firm due to the deaths of family members.

September 29, 2011 - According to reports a woman that was involved in an accident leading to the death of an infant has filed a lawsuit against the city of Huntington Beach.

According to reports Caryl Johnson age 53 of Huntington Beach has filed a lawsuit against the city of Huntington Beach, stemming from a chain reaction accident last year. The accident killed an infant from Australia, while being pushed in a stroller by her mother.

Johnson’s lawsuit filed September 16th in Orange County Superior Court states her car was struck from behind while she was stopped by a distracted driver, causing her vehicle to be pushed into the crosswalk and into the pedestrians.

Johnson claims to have been permanently disabled and suffers emotional scars; her husband is also listed as a plaintiff in the suit and alleges loss of consortium against the defendants. He lists that his wife is unable to perform duties as a spouse, work or services. ?
According to police reports, September 7, 2010 at the time of the accident, Johnson complained of neck and back pain.

Johnson’s lawsuit is suing Huntington Beach for allegedly maintaining a dangerous intersection at the location where the accident occurred on Croupier Drive and Sprindale Street. The lawsuit also names driver Robert Anthony Casares, age 50 of Huntington Beach for negligence.

According to police reports Casares who was driving a Chevrolet Tahoe northbound on Springdale Drive, caused the car accident when he did not see Johnson stopped in front of him. Casares was fixing his laptop from falling off the seat after going over railroad tracks on Springdale, according to police reports. With the school at University of Georgia and other colleges and universities having recently started, your college-bound young adult may be asked to join the Greek System and become part of a fraternity or sorority.

While the Greek system can provide an opportunity to develop future contacts, build a social network at a university and obtain access to a wide range of social and recreational activities, there is also a darker side to the fraternity and sorority experience. Pledge initiation, rituals and hazing that are a frequent part of the fraternity and sorority experience are often portrayed in movies and television as harmless hijinks. Unfortunately, many times hazing includes dangerous practices such as forced consumption of alcohol that result in catastrophic injuries or even wrongful death. Perhaps, the most surprising aspect of these hazing practices is that they are often carried out in public. Students in the study reported that 25 percent of the time an advisor, coach and/or alumni was aware of the hazing incident.

Hazing can lead to permanent life-threatening injuries including alcohol poisoning, serious head injuries, spinal cord injuries, paralysis and wrongful death. When students are forced to consume large quantities of alcohol, subject to physical restraints or deprived of adequate sleep by being woken throughout the night to be forced to submit to acts of humiliation, the results can be tragic.
