AppId is over the quota

Most of us don’t even think about how dangerous it is to get in the car and head out somewhere. We just don’t think about it. We do it every day, and yet we rarely stop to think that we’re really putting our lives at risk every time we are either a passenger or a driver on the roads of Dallas-Fort Worth. As a North Texas personal injury lawyer, I know that deadly wrecks happen throughout DFW on a daily basis. Some are caused by drunk drivers, but not every crash is the cause of such gross negligence.

On Saturday afternoon, for example, Juana Mancilla, 71, of Grand Prairie, was killed in a fatal two-vehicle accident at the intersection of Dickey Road and Texas 161 in Grand Prairie. Mancilla was a passenger in an SUV which allegedly ran a stop sign putting in the path of a van which hit its side. According to police, Mancilla was ejected from the SUV which then rolled over, landing on top of her. She was pronounced dead at the scene.
Both the driver of the SUV, Jose Cruz Mancilla, 41, and the driver of the van, Billy Bannister, 71, as well with four additional passengers in the SUV were taken to hospital by ambulance to be treated with what were described as non-life threatening injuries.
I don’t want to speculate on the cause of this terrible accident, since clearly as a passenger in the SUV, Mrs. Mancilla had no control over the vehicle she was riding in at the time of the collision. Naturally, my thoughts and sympathies go out to all those who were hurt in the wreck, as well as their loved ones.
Unfortunately, while it does not appear that there was any significant negligence prior to this accident taking place, it goes to show just how suddenly and without warning an auto accident can occur. We should all realize that getting behind the wheel is the most dangerous thing we do every single day. And we should all resolve to take much greater care while driving around DFW.
Serious boating accidents: the boat use liability for others
Serious boating accidents: the boat use liability for others
Summer is almost here and many people are always ready, enjoy their boat. A boat can be excellent source for fun and relaxation whether wakeboarding or fishing. However, a fun afternoon can quickly turn out on the water in a fatal boating accident.
The family purpose doctrine in Georgia applies to automobiles and boats. The doctrine States that an owner of a vehicle, the vehicle for the use and the comfort of his family, managed that owner for negligence a member of the family can be made liable, that the vehicle purpose was used for a family. For example, a son of the family takes over boat the weekend while they are on the Lake. The son meets an another boat and the people on the ship badly hurt. The father and owner of the vessel can be held responsible for his son's accident.
There are five elements to the family purpose doctrine, that if a victim sues an owner of a boat for negligence must be demonstrated:
The person has sued or has an interest in or control of the boat, which was distributed through negligence. The driver of the boat who was negligent is a member of the family (i.e. spouse, adult, or small child, siblings, etc.), lives in the household of the owner. On loan to the owner or a member of the family for "Joy, comfort and convenience" the vehicle to the members of this family. the owners of the borrowers has permission or consent at the time of the accident the boat for a "family purpose" use.It was enough authority and control over the use of the boat that there is no doubt that there was a relationship between the owner and the borrower.Another way that a boat can Georgia liable his or her boat during the negligent act of entrustment is doctrine caused for an accident of someone else worked. A boat can be liable for negligent entrustment Act where the owners experience a boat to someone who is incompetent because of age, loans, physical and/or mental condition or has known habit of ruthlessness. If the person used the boat an accident because of this ignorance, incompetence or recklessness caused, can be the boat owners liable for severe injury or wrongful death.
As an example allows a boat intoxicated take brother to know that the brother was intoxicated the boat on the Lake. If then the brother in a serious accident is boating and innocent people injured, the boat can be liable to for the boot someone who certainly work not in a position, the boat was entrusted.
Georgia imposed also legal agents liability on boat owners under O.C.G.A. § 51-1-22, the wider than under the family use doctrine. The Statute allows lends liability on a boat for injuries caused by the negligence of anyone to anyone, which the owner his or her boat, as long as it is explicit or implied consent, be imposed. If a member of the family used the boat will know the Statute, and implied consent. This boating statute places very broad liability on boat owners.
A boat can be just as dangerous as driving on public roads. People who drive boats are often on vacation and take a more relaxed approach you to operate a boat. Regularly drink a few people who never drink and drive at the boating. Boat owners underestimate sometimes the potential danger of a serious boating accident, because the amount is roadway traffic and traffic jams not so serious as to Georgia.
The potential for fatal boating accidents can add all of these conditions. If this dangerous mix some the inexperience of the boat operators is added, the results are often tragic.
