Pedestrian safety: Amtrak train accident in Southern California kills three men walking along tracks

Three pedestrians were killed on Monday, Dec. 13 when they were struck by an Amtrak train headed from San Diego to Los Angeles, according to KTLA News in Los Angeles. Thought to be possible taggers, the men in their early- to mid-20s were walking along the train tracks over Telegraph Road when the Amtrak train struck the pedestrians.
The conductor of the train tried to avert the pedestrian accident but could not apply the train’s brakes in time, causing a fatal collision with the men. LA County fire department and LA Sheriff Homicide detectives arrived on the scene shortly thereafter and pronounced the men dead.
A train accident is rare. Pedestrian Struck and Killed by Driver Suspected to be Under the Influence

October 22, 2011- According to reports a pedestrian was struck and killed by a driver suspected to be under the influence at the time of the crash.
According to Anaheim Police Department a man was struck and killed at approximately 5:15 a.m. in the 500 block of Beach Boulevard in the vicinity north of Orange Avenue and south of Lincoln Avenue.
Anaheim Police Sgt. Bob Dunn stated that the Saturday morning incident involved a 2000 Chevrolet S 10 pickup truck that was traveling northbound on Beach Boulevard when the pedestrian described to be a man in his 50’s was walking in the road.
The pedestrian that was struck was pronounced dead at the scene of the crash, Dunn stated. The driver was identified as Alexandro Cedillo age 36 of Stanton, who was arrested at the scene of the accident for suspicion of driving under the influence of alcohol and a controlled substance. Cedillo was arrested and transported to the Anaheim City jail.
According to Sgt. Dunn, investigators believe the man might have been struck by other vehicles and have spoken with one witness and are looking for other witnesses and drivers. Pedestrian 76 Years Old Dies When Struck By a Vehicle in Santa Ana

November 1, 2011 - This is another sad situation in the news. According to reports a 76 year old pedestrian died after being struck by a vehicle in Santa Ana.
The Santa Ana Police Department Cmdr. says the man was struck at approximately 8:00 a.m. The pedestrian identified as Samuel Suh was struck in the 500 block of West 15th Street by the driver of a sedan. Cmdr. Owens said the driver remained at the scene of the accident and the accident occurred when the driver turned from North Van Ness Avenue onto W. 15th street, traveling eastbound.
Suh age 76 was transported to Western Medical Center in Santa Ana after being struck where he was pronounced dead later in the afternoon. According to Cmdr. Owens it was not clear if Shu was in a designated crosswalk at the time he was struck by the sedan. In other words, there are not enough facts to determine if the man was lawfully in a crosswalk or if he had already crossed. At least that is my take on this.
The good news is that the driver remained behind. Assuming arguendo, the vehicle driver hit the man when he had the right of way, the driver would be legally liable for the wrongful death of the pedestrian.
However, issues of pure comparative negligence rear their head. In other words, this was on old man. Was he partially responsible? Only time will tell. Pedestrian Killed In Rancho Cucamonga By Metrolink Train

October 14, 2011 - I have been covering these fact patterns a lot in the news lately as a Rancho Cucamonga personal injury attorney. Here is another sad story involving a train. According to reports, a pedestrian was killed when struck by a Metrolink train in Rancho Cucamonga. According to authorities a pedestrian was struck at approximately 4:35 a.m. by the 301 Metrolink train at Hellman Avenue.
Metrolink officials stated that there were 190 passengers on the train and none of the passengers were injured during the accident. Authorities are unsure why the pedestrian that was struck was on the tracks Friday morning. Pedestrian struck and killed by driver suspected under the influence
October 22, 2011-according to reports was a pedestrian struck and killed by a driver, the suspicion that under the influence at the time of the crash.
After Anaheim was hit and killed at approximately 05: 15 in the 500 block police a Beach Boulevard in the vicinity of Orange Avenue to the North and South of the Lincoln Avenue.
Anaheim police Sgt. Bob Dunn explains that 2000 Chevrolet S-10 pickup, which Boulevard was traveling north on beach in the Saturday morning incident one, if pedestrians are described, that a man in his 50s went on the road.

Downtown Dallas Plans Improvements To Bike And Pedestrian Safety

Following in the footsteps of Fort Worth and Arlington, the city of Dallas is now considering ways to improve the downtown area for pedestrians and cyclists in addition to cars, trucks and motorcycles. There are no solid plans so far, however, and early ideas have included a variety of different approaches. One council member suggested the extreme (and ultimately unhelpful) idea of shutting Main Street to motor vehicles entirely to create a single pedestrian zone, while others favor the more useful and cost-effective idea of creating new special-use lanes throughout the city as part of scheduled repaving construction.

The proposals are the result of Dallas receiving an $800,000 grant intended to be used to improve city roads to make them safer for bicycle riders and pedestrians.
As a Dallas County personal injury lawyer, I think this is a great idea. Having dedicated bicycle lanes can really make a difference to cyclist safety – particularly in busy urban areas such as downtown Dallas. Stranded Pedestrian Killed In Fatal Accident Near The Colony

A garbage truck traveling northbound on the Sam Rayburn Tollway in The Colony hit and killed a stranded motorist that was trying to cross the highway. The motorist was hit around 6 a.m. after he attempted to cross Highway 121 between Main and Paige Road.
The truck accident caused a traffic nightmare for those driving the tollway as they had to use the highway’s frontage road during morning rush hour.

Pedestrian Hit by Police Officer Speeding Sues Huntington Beach—Claims He was on Cell Phone

September 23, 2011 - A woman has filed a lawsuit charging that a police officer hit her, while speeding and talking on a cell phone in Huntington Beach, during a car crash.
The woman identified as 47 year old Catherine Sanchez filed a lawsuit Monday in Huntington Beach stemming from a May 30th incident. Sanchez claims she was crossing Main Street when she was hit by an officer that was speeding and talking on a cell phone.
According to attorney Dyke Huish, who represents Sanchez, she would have been injured much worse if her son had not pulled her out of the way, but suffered bruising and pain to her back when she was struck by the police car on the left side of her body. Sanchez has claimed emotional distress due to the incident.
Attorney Huish stated that the officer stopped only long enough to yell at Sanchez to get out of the way and left. The Huntington Beach Police Department is denying the incident took place, while Huish has stated he does not believe police officers should be using cell phones and should not be permitted to leave the scene.
According to Huntington Police Department Chief Ken Small a police report was not taken, since the officer did not leave the scene and the woman was not struck by the vehicle. Small has stated that Sanchez did not say she was hit by the police vehicle and witnesses have also stated she was not struck by the car and because of this a report was not taken.

Pedestrian Killed in Early Morning Collision

September 21, 2011 - According to reports a pedestrian was struck and killed in an early morning accident.
According to Westminster Police Cpl. Cameron Knauerhaze the accident occurred at approximately 4:18 a.m. Wednesday morning in the vicinity of Beach Boulevard and McFadden Avenue in Westminster.
Cpl. Knauerhaze stated that the pedestrian was pronounced dead at the scene of the incident and the identity of the fatally injured pedestrian has not been released pending notification of their family.
The Westminster Cpl. Stated that the driver of the vehicle was not injured and police do not believe that alcohol does not appear to have been a factor in the accident.
Lanes were opened back up for traffic at approximately 9:00 a.m. and the crash remains under investigation, according to authorities. Detroit pedestrian accident lawsuit filed - brain trauma, TMJ, fractures - car accident
Our customer was grace EMS Sinai Hospital transported where she was admitted for a week.
