Coronado suspected DUI accident sparks San Diego woman’s arrest for murder: How California driving laws can affect you.

A San Diego woman was arrested on charges of murder in connection with a suspected DUI accident that occurred in Coronado earlier this year in April, according to The San Diego Union Tribune. Melanie Rebecca Flores, 47, was booked at the Las Colinas Detention Facility on Tuesday, Dec. 14 on accusations of drunk driving. The car accident killed Coronado resident Stevens Benjamin Freidman, 95, and two others were also injured in the accident.
Flores is suspected of driving while intoxicated on April 21, when she collided with two vehicles on the Silver Strand in Coronado. The fatal car accident claimed the life of an elderly man and injured two others, but the San Diego woman was not arrested until recently.
Lea Corbin, a Coronado police spokeswoman, said the delay in arrest was due to serious personal injury that Flores sustained.
Flores’ blood alcohol limit at the time the car accident was above the California legal limit of .08 and she is now being charged with murder. Flores is being charged with 2 counts of 23153 (A) CVC DUI causing injury, and 2 counts of 23153 (B) CVC DUI over .08 causing injury.
What do these laws exactly mean?
Did you know there are two parts to California DUI driving laws that can affect you? The first offense, California Vehicle Code 23152 (a), is a law that defines whether or not the driver was “unable to drive the automobile with the same caution characteristic of a sober person, of ordinary prudence, under the same or similar circumstances.”
The other part of California law, California Vehicle Code 23152 (b), focuses on the “per se” charge of “was the driver’s blood alcohol level .08 or higher.” In Flores’ case, Coronado Police Department reports she was indeed driving at a blood alcohol level greater than .08 percent.
Because the accident caused a fatality, it appears that Flores was unable to drive the automobile with the same caution as a sober individual. She was arrested on charges of murder a result.
Every state has nuances in their laws governing DUI driving, but in California, driving with a blood alcohol concentration of .08 percent or higher is considered driving under the influence of alcohol. In Flores’ case, she will be facing both criminal charges and she’ll have her license suspended as well since she was driving at a BAC level above .08 percent.

Pedestrian Struck and Killed by Driver Suspected to be Under the Influence

October 22, 2011- According to reports a pedestrian was struck and killed by a driver suspected to be under the influence at the time of the crash.
According to Anaheim Police Department a man was struck and killed at approximately 5:15 a.m. in the 500 block of Beach Boulevard in the vicinity north of Orange Avenue and south of Lincoln Avenue.
Anaheim Police Sgt. Bob Dunn stated that the Saturday morning incident involved a 2000 Chevrolet S 10 pickup truck that was traveling northbound on Beach Boulevard when the pedestrian described to be a man in his 50’s was walking in the road.
The pedestrian that was struck was pronounced dead at the scene of the crash, Dunn stated. The driver was identified as Alexandro Cedillo age 36 of Stanton, who was arrested at the scene of the accident for suspicion of driving under the influence of alcohol and a controlled substance. Cedillo was arrested and transported to the Anaheim City jail.
According to Sgt. Dunn, investigators believe the man might have been struck by other vehicles and have spoken with one witness and are looking for other witnesses and drivers. October 11, 2011- You know, I write a lot abut different things. But I never could understand why someone would get behind the wheel of a car after drinking. So here we go, according to reports five people were injured in a two car collision in the early morning hours. According to Huntington Beach Police they responded to an collision at approximately 1:27 a.m.
The accident occurred on Beach Boulevard and Newman Avenue in Huntington Beach. The two vehicles involved were a Toyota Camry that was traveling north on Beach Boulevard, when it struck a Dodge Durango broadside that was traveling South on Beach Boulevard.
The driver of the Camry has been identified as Forrest Leland Kelly age 22 and the driver of the Dodge has been identified as 28 year old Thomas William Barrett of Costa Mesa. Barrett had three passengers inside of the Durango and was attempting to make a U-turn, when the crash occurred, according to Huntington Beach police.
The collision caused the Durago to flip over on the road and caused significant damage to both vehicles. According to Huntington Beach paramedics the driver and three passengers in the Dodge Durango and the driver from the Toyota Camry were transported to the hospital with injuries. All five of the collision victims were listed in stable condition.

Crash Kills Two Women—Teen Driver Suspected of Driving Under the Influence

October 4, 2011-According to reports two women were killed in a collision with a teen driver suspected of driving under the influence. According to Anaheim Police Sgt. Rick Martinez the accident occurred at approximately 4:00 a.m. in the 1600 block of Harbor Boulevard in the vicinity of Disneyland on Saturday.
The two women reported to be homeless were in a cross walk, according to police reports on Monday, when they were struck. The women were on the eastside of Harbor Boulevard at the time they were struck by a Chevrolet Astro van that was traveling southbound on Harbor Boulevard.
According to Sgt. Martinez one of the women was thrown into the southbound lanes of traffic, a distance from where she was struck and the other woman was thrown into the left-turn lane in the northbound lanes.
