Pedestrian crosswalks are found in all populated areas and these are used to indicate that a pedestrian has the right of way over passing vehicular traffic. Traffic signals are found in most developed areas in order to designate right of way on the more congested roadways. The purpose of these is to expedite the flow of traffic in a safe and orderly manner by allotting timed intervals for vehicles to proceed from each direction. The intervals are programmed with certain factors in mind such as traffic volume, the location of other traffic signals and pedestrian crossings. Vehicles that are emerging from a private access must yield to motorists travelling on a public road with the exception of drawbridges, rail crossings and emergency vehicles.
Intersections that have no signals and particular roads at busy intersections may have temporary dominance whereby a break in traffic must be achieved which, in turn, gives temporary dominance to the other road.

NATIONAL TRUCK LAWYERS PROGRAM IN NEW YORK CITY

Last week I moderated the morning session of the national conference for the American Association for Justice's Trucking Litigation Group. This is a group of truck accident attorneys from around the country, as well as lawyers who are learning how to handle their first truck accident cases. This is the sort of continuing legal education you want your lawyer to have if they are going to handle your trucking case. See my prior post on "how to hire a great truck accident lawyer"
The litigation group’s mission is to educate and prepare lawyers on how to handle truck accident lawsuits and to work with safety authorities on the national and state level to make trucks safer on the roads and to reduce the number of truck wrecks. I am a past president of the trucking litigation group.
The program this year was terrific. Some of the topics that were covered include:

Truck Drivers on Drugs - Meth

I post frequently on the danger of impaired drivers, and specifically the dangers from impaired truck drivers. Not much surprises me anymore, this one did:
The Courier-JournalA Mississippi truck driver was arrested Thursday morning after Kentucky State Police found two active methamphetamine labs in the sleeper portion of his truck during a traffic stop on Interstate 71 in Carroll County.
Bobby K. Mitchell, of Myrtle, Miss., was charged with speeding, driving under the influence, manufacturing methamphetamine, unlawful possession of methamphetamine precursors, possession of a controlled substance and drug paraphernalia, according to a release from Kentucky State Police in Campbellsburg.
Police received erratic driving reports about the northbound truck around 10:30 a.m.
After a trooper pulled the vehicle over at the 43-mile marker, Mitchell was determined to be under the influence and a search of the truck followed. Police said Mitchell was cooking methamphetamine while he was driving.
The truck was hauling furniture, police said.
A state police hazardous materials technician responded to the scene and seized the labs.
Mitchell is being held in the Carroll County Detention Center, police said.

Roadcheck 2011 - Unsafe Truck Drivers and Trucks on the Roads

The Commercial Motor Vehicle Safety Alliance (CMVSA) held its Roadcheck 2011 event in June this year. This event asks for all states to inspect trucks on the road. Less than 1% of trucks are inspected. By announcing the inspections 4 months in advance, the CMVSA gives drivers and trucking companies four months to prepare, or if the problems are serious enough, to simply stay off the road for a few days.
Despite the huge publicity of the inspections in the trucking industry, the 3 day inspection in 2011 found almost 20% of the inspected vehicles and drivers failed a Level 1 inspection. The fact that truck drivers are on the road in an unsafe condition, knowing that this special inspection will be run, shows how drivers believe the chances of being inspected are so rare that they believe they won't be caught, or that they are so ill trained that they think they are safe.
Nationwide data show that in 2010, log book violations (logs are designed to keep tired drivers off the road) were the most common reasons for drivers being placed out-of-service at 29.5 percent of driver out-of-service violations. The most frequent out-of-service item for trucks was unsafe brakes comprising 25.5 percent of all vehicle out-of-service violations.
Thus the real danger: tired truckers, driving trucks with bad brakes, who don’t realize they are falling asleep until it is too late and who cant stop when they realize what is going on.

South Gate Collision Involves Tanker Truck and Freight Train

September 30, 2011- According to reports a freight train and tanker truck collided in South Gate. According to Los Angeles Fire Department spokesman Matt Levesque the collision occurred at approximately 11:52 a.m. in the vicinity of Salt Lake Avenue and Nardine Street.
The tanker truck was carrying approximately 100 gallons of oil at the time of the collision on Friday with the freight train. A hazardous material team was sent to the scene of the collision and they determined it was non-toxic vegetable oil the truck was carrying.
The train involved in the collision was identified as a Union Pacific freight train, according to Union Pacific spokes person Aaron Hunt. Hunt stated that it appears the tanker truck was attempting to beat the train, crossing the tracks.
Authorities state it is unclear what caused the collision, and it remains under investigation. According to spokesman Levesque, driver of the tanker truck suffered minor injuries in the collision. Video Shows Cyclist Intentionally Hit By Pickup Truck Driver

Unbelievably, despite the video evidence of the assault and an independent witness who confirmed the wreck was intentionally caused by the pickup driver, no assault charges were brought against the dangerous motorist. That is ridiculous, disgusting and absolutely absurd!

Lake Forest Pickup Truck Rollover Crash Kills Passenger

September 19, 2011 - According to reports a pickup truck rollover crash caused fatal injuries to the passenger in the vehicle.
According to the California Highway Patrol the pickup truck crash occurred at approximately 1:12 a.m. pm the 241 toll road in the vicinity of Portola Parkway in Lake Forest.
The California Highway Patrol stated that the driver of the pickup truck, a Toyota Tacoma had left Los Angeles an hour prior to the rollover crash on the 241 toll road.
The driver told officers that he was tired and the truck drifted to the right shoulder of the road and veered onto the dirt median on the left shoulder due to the driver over correcting and the soft dirt on the shoulder caused the truck to flip over.
According to the California Highway Patrol the woman that was killed in the accident was an 18 year old woman from Santa Margarita and has been identified.
The driver was transported to Mission Hospital in Mission Viejo for treatment and his name has not been released. The California Highway Patrol both Sams and the driver were wearing seatbelts at the time of the crash and Sams was partially ejected from the vehicle.
