Walgreens looses wrong prescription case
AppId is over the quota
BARTOW, Fla. – A jury awarded $25.8 million Friday to the family of a cancer patient who was given a wrong prescription, had a stroke and died several years later, lawyers said. Beth Hippely was prescribed Warfarin, a blood thinner, in 2002 to treat breast cancer. The prescription filled at a Walgreens pharmacy was 10 times what her doctor prescribed, court documents said.
The Polk County Circuit Court jury found the prescription error caused a cerebral hemorrhage resulting in permanent bodily injury, disability and physical pain. The mother of three died in January at the age of 46.
A 19-year-old pharmacy technician, with little training, misfiled the prescription, according to court documents.
The lawsuit was filed in 2003 by Hippely, her husband Deane Hippely and their children against the Deerfield, Ill.-based Walgreen Co. for negligent breach of duty and wrongful death.
“Beth Hippely died unnecessarily because this tenfold overdose with Warfarin by the pharmacy she trusted caused her cancer to come back with a vengeance and it interrupted all of her cancer treatments,” her lawyer Chris Searcy said. “They have been seeking justice for almost five years and this was a case that screamed out for justice.”
A statement released by the company expressed sympathy for the Hippely family.
“We’re truly sorry for what the Hippely family has been through, and we’ve personally apologized to them,” Walgreens spokeswoman Carol Hively said in a statement. “We have been, and continue to be, the leader in pharmacy safety initiatives. We had hoped the verdict would have been fair and reasonable.”
Hively said the company had not decided if it would appeal the decision.
A Psychiatric Disability Case Gone Wrong For AT&T
AppId is over the quota
Here's a great case out of Tennessee in which the insurance doctor made a decision to deny with hardly any information. That's dangerous because what if they then miss information that makes it an obviously valid claim? Well then they get sued and taken to court and that's exactly what happened.
It was a psychiatric disability case and those are tricky and require a bit more attention from the disability insurer. Dr. Grimes, the reviewing psychiatrist made the decision to deny based on the opinion that the claimant was able to perform her job. She made that decision without any knowledge of the claimant's job, without interviewing the claimant, and without consulting with all of the claimant's treating mental health professionals.
That might fly in physical disability cases because often the records can speak for themselves, but when they're dealing with psychiatric disability it's important to have a physician actually meet with the claimant to determine the extent of the disability. Unfortunately that's not how the insurance companies want to do it, so they don't. Trying to save a little time and money and they're asking for litigation. Well, again, they got it. Next time they should take the time to actually review the claim and save everyone the hassle of court by accepting the initial claim.

Court was Wrong to Dismiss Case-Now the Parties Wait Longer for Justice
AppId is over the quota
Posted on Mar 04, 2008
A typical tactic used by Virginia medical malpractice insurance companies to defend claims ateries are mistakenly clamped or sutured or cut in surgery is to say "well, the anatomy was abnormal," and that's why it happened.
The Virgnia Supreme Court recently held that a trial court was wrong in dismissing a case where there was conflicting evidence that there was abnormal anatomy.
Clifford Lewis Fanucci, Sr., died after undergoing hand-assisted laparoscopic surgery for a cancerous growth on his kidney. Daniel Mark Hoffman, M.D. clamped the right renal artery instead of the left renal artery during surgery. When he discovered his error, he unclamped the artery but it tore, killing his patient.
There was conflicting evidence at trial about whether Fanucci's anatomy was unusual. Doctors who came in to repair the torn right renal artery that they found nothing abnormal. The pathologist who did the autopsy said he found nothing unusual about the position of the right renal artery, either.
The only doctors to testify that there was anything 'unusual' about the right renal artery were the defendant and his partner!
The Supreme Court reversed the decision of the trial court and ordered a new trial.
Comment from Virginia Medical Malpractice Attorney Ben Glass: the actions of the trial judge are frightening and demonstrate just how difficult a jurisdiction Virginia is for medical malpractice cases. As I read the opinion, there was basically guess-work on the part of the defendant and his partner as to how or why he managed to clamp the wrong artery. There was no real 'evidence' on this issue. In fact, the only real 'evidence' from two indepedent doctors who actually saw the right renal artery was that the anatomy was normal. To me this case is not even close and there is no way the judge should have stopped the jury from making the decision.
This was enourmously expensive for both parties. Even if the judge felt the case should not have been decided by the jury he should have allowed them to decide it later. Then, he could have reversed the jury's decision, but at least the Supreme Court could have reinstated the jury's verdict.
The judge was wrong.. now the parties wait at least another year, spend another $$75,000 or so to retry the case.
Payee notification in Virginia-some lawyers against it and they are wrong
There is payment recipients in Virginia a simple solution and its notification.
Amazing, against some lawyers in Virginia of this consumer protection statute.
They need it to questions, why.
I invite to "have it" on this blog and express their opinions as why Virginia payee notifications now not should adopt.

Wrong way driver down - 30 after the collision with an 18 Wheeler
How often does drunk drivers accidents in Texas? A Mansfield woman with a history of alcohol-related arrests, this morning the wrong way drove Interstate 30 to the East and crashed into an 18-Wheeler drag fuel your car down. After the truck car was hit by drunk driver, it jack knifed and about 100 litres fuel spills. Fortunately, the truck driver was ok, but as for the Mansfield woman, she is in very critical condition at Baylor Medical Center.
Messy, this was an accident. Emergency teams had in the woman's car, to free her cut and the motorway had to remain devastation closed just before the morning rush hour for several hours. If you had to drive today morning on I-30, I am sure that this accident your commute affected. All due to the idiot decisions by one person.

A bad name by many drivers, but it the 18 Wheeler is get truck driver not always them to cause accidents in Texas. As a result are their broadcast schedules these hard-working people out there go all hours of the night. Unfortunately, this is when much intoxicated to drive driver. Although the investigation underway and police have not officially said, if this young woman was intoxicated, feel I almost sure that it was me. I mean come on, how you do not know that you go to the wrong side of the, if you are drunk?
Police said this woman has a history of alcohol related arrests - it is only 25! How many times it takes the point to you! It is crazy me, that the State of Texas can have an impact on this problem. I try to do what I can keep responsible as a drunk driving accident Attorney Fort Worth, these criminals for their actions. I really hope that this young lady makes a full recovery; It is only 25 and has the rest of their lives to get it together. Maybe this time they can finally learn their actions and put the bottle.
Are you a step in the wrong direction of Sunday alcohol sales?
DUI in Georgien

Could the pathologist of the breast cancer diagnosis was wrong
It is not breaking news.
In 2006 Susan G. Komen for the cure, a survivor of breast cancer organization, published a study with alarming results. According to the New York Times, these researchers reports that in 90 000 cases, women who were diagnosed with DCIS or invasive breast cancer "not the disease or its pathologist have either an other error that resulted in incorrect treatment."
This 2006 study was, not in isolation. In the year 2002 doctors at Northwestern University Medical Center saw the pathology of 340 patients with breast cancer and discovered that in addition to 8 percent of cases had errors. These errors were significant enough to change the plans for surgery.
The New York Times pathologist also reported a San Francisco, 597 breast cancer cases from 2007 and 2008 checks found discrepancies in 141 of them.

How hospitals can prevent the wrong limb
No one wants to be the victim of medical malpractice. Unfortunately, these errors occur (at a rate that may surprise you). People can jokes about the idea of writing "Cutting not this stage" to itself with a marker before you, but it is this kind of provision which can avoid years of pain and suffering.
We are happy to announce, that Fairfax surgical center which has right and preparing a patient for surgery is marked before they went into the operating room. They took measures to avoid a false unilateral surgery.

It now is, how, that it should be done. Future patients Note: If you do not want to suffer to everyone extra because of an error in which flip, is odds of a unprepared surgeon must tell quite clearly there, where the knife should go, and should not go.

Insurers wanted to not the responsibility of the patient wrong site surgery to take
What would have been a routine surgery, turned into a fiasco. The nurses in Surgery Center prepared the patient's back shoulder surgery. The problem started however after Mrs Fincher was under anesthesia. Dr. Snedden examines the two sides of the shoulder and the Lipoma is not found. After examination, he decided the MRI carried out previously, that the lump was the shoulder on the front, in spite of, that a radiologist had reported that the was Lipoma on back.
Dr. Snedden was tried on a research find the Lipoma. He split unnecessary muscles and tissues. In all, the investigation and decomposition of tissues and muscles, the Lipoma is not removed.
Mrs Fincher again Sneddens Office the next day. If was removed the dressing, you could see even the Lipoma. Dr. Snedden admitted to the mistake. The surgeon medical malpractice insurance company but claimed that the surgeon wrong nothing have, not the patient attempt, the event rules.
While this could be a smaller medical malpractice case, Mrs Fincher wants to make a point. You have to get up and responsibility to assume, if you make a mistake.
Here's my take - we have something and, that something is not for tort reform cry and refuse to valid claims.

Lawyer sues wrong practice - VA Supreme Court upheld a complaint
Weatherbee's suit against Dr. Ward Vaughan was dismissed as "frivolous" and Weatherbee a public rebuke from VA state bar.
Not sure how "Bob" and "Ward" get mess but it is simply to show why you need to handle an experienced medical malpractice attorney in your case.
Here is the VA state bar notice of Michael Weatherbee. It explains in detail how he violated standard therapy for the treatment of medical malpractice cases.
Weatherbee appealed the complaint to the SCoVA, but she confirmed the allegation. Good for them.

MedMal cases wrong in Virginia's largest judgment
However, that $7.4 million is not what the plaintiff was awarded, simply what thought the jury the case was worth. Unfortunately the jury judgment medical malpractice Cap (i.e. found missing between 1 July 2001 and 1 July 2002) to the current Virginia of $1.6 million and is only 15 highest verdict in Virginia for 2009.
The story is the same for the other medical malpractice cases. In fact, if you in the caps each medical malpractice judgment applied to factor, just a case makes the top 10, a judgment $ 1.85 million, and it has rankte Darden as number combo 10., the million dollar-Medmal judgments from Virginia in 2009 total $ 11.72 million not just the largest 2009 ruling in the State, a 13.5 million US-dollar false advertising claim.
Food for thought is the next time the someone you that says medical malpractice reforms required. Unfortunately, it is already here and the plaintiff's their only recovery since 1999 refuse served has.

Text & tables before abuse & fraud charges goes wrong after breast augmentation
According to the recent opinion of Dr. Wray the patient told of the sponge but said that the complications were not related to the sponge. One of the nurses at the Lewis Gale clinic, Katherine Vaughan, this confirms the patient and told them that there no legal claim, because the sponge was not the cause of the problems.
Repeated surgery (on the clinic dollars) and again the implant had the same problems and has been removed. Finally, it has some other work to insert an Expander square make for a future implant and simplify the process of adoption. Right, before it was sent in the OR for the operation, the patient received a release and a check for the cost of the original surgery. This version was an agreement the defendants hold not be liable for the cost of surgery.
Now is the shady. I wonder if it happens much, or is this only an aberration. Let us hope that it is.
I have the latest on this medical malpractice and medical fraud case here.
