Is your child seat safe? Get it inspected for National Child Passenger Safety Week
AppId is over the quota
Posted on Tuesday, September 20th, 2011
This week is National Child Passenger Safety Week, which serves as a reminder that while we’re getting better about buckling up our kids in the backseat, motor vehicle crashes are still the leading cause of death for children between ages of 3 and 14.
The National Highway Traffic and Safety Administration (NHTSA) is using this week to promote child safety education for parents. A new study from Safe Kids USA indicates that while almost all parents are restraining car seats in the backseat, only 28 percent of drivers who carry young passengers are properly using the tethers that secure child seats in collisions. Often the inspected tethers were secured too lowly or not at all. The tethers are a vital safety measure because they keep children’s heads from moving too much during crashes.
The study also raised concern that many parents are not aware of the latest best safety practices for children of different heights and weights. For instance, in 2010 the American Academy of Pediatrics updated their guidelines to recommend that children under two ride in rear-facing seats. However a recent poll showed that only 27 percent of parents had received that message. Almost three quarters of parents reported turning their kids around before year two, and 30 percent before year one.
The results are somewhat alarming considering that, according to the NHTSA, properly used child safety seats decrease the risk of death by 71 percent for infants and 54 percent for toddlers. Even older children are 59 percent less likely to be injured in a booster seat than if they were using seat belts only.
To help educate the local Contra Costa County community, the firefighters from Local 1230 are ramping up their driver education services. The Fire District now has seven nationally certified Child Passenger Safety Technicians who can inspect cars and educate parents and caregivers on the best practices for child passenger safety seats.
The Fire District says that inspections last between a half hour and an hour, depending on the seat and whether any issues are found. These inspections are a convenient and free way for parents and caregivers to make sure that they are using the seat correctly, and that the seat itself has not been recalled. In addition to the inspection, the safety technicians will educate parents on the latest in child passenger safety, and go through the proper way to install child seats.
To take advantage of this Contra Costa Fire Protection District service, call them at (925) 941-3326 or send an email to childcarseat@cccfpd.org.
Nationwide safety inspections
You don’t have to live in Contra Costa County to meet with someone to inspect the safety of your child seat! This Saturday, September 24th, is National Seat Check Saturday. For the finale of Child Passenger Safety Week, certified child safety seat technicians will be on hand at locations around the country to inspect cars and assist with correct installation.
Just head to the NHTSA website and plug in your zip code for a list of locations near you! It’s a great opportunity to get the information that could save the life of a child you love.
East Bay family awarded $11.7 million in Marsh Creek Road wrongful death accident

Late last week, a jury ordered Contra Costa County to pay $11.7 million to the family of William Tindall, who was killed in a crash on Marsh Creek Road in August 2008. The jury found that the County had created, and had notice of, a dangerous condition of public property at the accident location while the road was being resurfaced.
Unfortunately, Mr. Tindall was not the first victim of the 2008 Marsh Creek Road resurfacing project. Just five days earlier, a woman died when she skidded off the road and into a tree. Evidence was presented that, during three separate resurfacing projects since 1994, fifteen serious accidents had occurred, including the last, the one that killed Mr. Tindall.
Mr. Tindall, a long-time East Bay resident, was on his way to a plumbing job at a local hospital when he stopped to assist a driver who had overturned his SUV after losing control on a gravel-covered curve. Only moments later, a second car struck and killed him, when its driver lost control on the same patch of road.
Luke Ellis of this firm represented the Tindalls in their lawsuit against the County and the California Highway Patrol. The jury awarded $1.5 million in economic damages, and $10.2 million to his widow and daughter (now age 13) for their loss of his love, care and companionship. Mr. Ellis commented on the verdict: “Mr. Tindall was a wonderful man, someone who stopped coming from an opposite direction to help a stranger in distress. The damages awarded were very fair and reasonable based on the extremely close relationship Mr. Tindall had with his wife and daughter, and we appreciate all the time, care and attention spent by the jury on this case.”

September 27, 2011 - According to reports a father, infant and toddler were injured at a Huntington Beach crosswalk by a motorist on Monday afternoon.
According to Huntington Beach Fire Department Deputy Fire Marshal Jeff Lopez, the accident occurred at approximately 4:30 p.m. at Central Park Drive and Edwards Street.
Huntington Beach Police Department Lt. Mike Reynolds said that investigators believe the man and two children were struck while in the crosswalk, by a motorist making a left hand turn onto the northbound lane of Edwards Street.
Lt. Reynolds stated the accident occurred at a four way stop, where the driver is believed not to have seen the pedestrians crossing from east to west on Edwards Street.
The father was holding a one year old at the time they were struck and a three year old was on a tricycle, Lt. Reynolds said. The father and one year old rolled over the hood of the vehicle sustaining minor injuries, including bruises.
The vehicle reached the top of the tricycle injuring the three year old that was wearing a helmet at the time of the incident, according to Lt. Reynolds. Huntington Beach Police stated that a helicopter was placed on standby, but was later canceled. The father and two children were transported to UCI Medical Center by ambulance for treatment of their injuries.
According to Huntington Beach Police investigators the accident remains under investigation, including why the driver failed to see the man carrying the one year old infant and the three year old on the tricycle. 600 Anton Boulevard 11th Fl. Top 10 Movie Car Crash Scenes
AppId is over the quota
Twisted metal, screeching brakes, plumes of fire, and airborne vehicles. There’s nothing like a good car crash scene to keep you on the edge of your seat. This article explores ten of the best movie car crash scenes ever. Pass the popcorn!
1. The Matrix Reloaded (2003) The crash scene in this movie comprises two trucks meeting in a head-on collision at full speed. The scene took three months to film, and destroyed 300 cars in the process.
2. Bullitt (1968) Steve McQueen pilots his Mustang at high speeds through the streets of San Francisco, keeping movie viewers on the edge of the seats with quick driving and crazy stunts. The chase ends in a fiery, but satisfying, conclusion.
3. Thelma and Louise (1991) Sometimes when your actions have seriously spiraled out of control and you find yourself cornered by police, the best course of action is to stomp on the gas. Instead of being captured and potentially spending the rest of their lives in jail, Thelma and Louise, two “normal” women who find themselves in circumstances that are anything but normal, put the pedal to the metal and drive over a cliff.
http://www.youtube.com/watch?v=4z88U915uq8
4. Vanilla Sky (2001) Julie (Cameron Diaz) causes an accident when she argues with David (Tom Cruise), her former boyfriend, about his lack of interest in her. Julie’s goal is to kill both herself and David, but the gruesome crash results only in Julie’s death (or does it?), while David is horribly disfigured.
5. No Country for Old Men (2007) Anton Chigurh (Javier Bardem) is the victim of a horrific crash. What makes this scene so good is the realistic filming. You can almost feel the sudden impact and resulting whiplash. What’s more amazing is that Anton Chigurh walks away with only minor cuts and bruises, and an injured arm.
6. Meet Joe Black (1998) Joe Black (Brad Pitt) shows us exactly what can go wrong when you start to daydream about a girl while crossing a busy intersection. We think Joe’s has averted death when he’s barely missed by a speeding car, but then he’s hit by a van coming in the other direction and flipped onto the windshield of a taxi.
7. Death Proof (2007) A demented stuntman uses his “death-proof” vehicle as a murder weapon, killing a group of women enjoying a night on the town. Director Quentin Tarrantino shows the crash multiple times, revealing how each passenger perished in the collision.
8. Final Destination 2 (2003) What do you get when you combine a spilled cup of coffee and a malfunctioning logging truck? Total mayhem and one of the movie industry’s greatest pile-ups, including colliding cars and motorcycles, twisted metal, and vehicles on fire. This carefully scripted scene is sure to have you on the edge of your seat.
http://www.youtube.com/watch?v=DDsSt3BlqlI
9. Adaptation (2002) John Laroche (Chris Cooper) backs his car into an oncoming truck. This is one of the simplest movie car crash scenes, but also one of the most realistic. Like a real crash, you don’t see it coming, and it’s over in a couple of seconds. But the sound, the camera angles, and the silence afterward are all too real.
10. Terminator I (1984) The Terminator (Arnold Schwarzenegger) says his famous words, “I’ll be back,” when a police officer at the front desk gives him the run-around. Just a short while later, he makes good on his words by ramming his car into the police station.
If you’ve recently been in an automobile accident it may have not been quite as dramatic as the car crash scenes listed above, but that doesn’t mean it hasn’t captured your attention. Dealing with injuries, insurance issues, and hospital bills may not be exciting enough to make a movie scene, but they’re no fun when they are happening to you. If you’ve recently been injured in an automobile accident and you believe someone else is responsible, be sure to make an appointment to discuss your case with an experienced car accident attorney.

La Crescenta Police Officer Helps Woman Stop Run Away Ford Focus

September 23, 2011 - As a car accident lawyer in Los Angeles, it is not often I hear stories that have a happy ending. According to reports a woman was uninjured after a police officer helped to stop a Ford Focus that had gone out of control.
According to authorities the incident occurred at approximately 11:20 a.m. Thursday in the vicinity of Pennsylvania Avenue and Foothill Boulevard.
According to Deputy Marcelo Ruiz he was in his police vehicle when a woman driving a Ford Focus waved in a manner that signaled she was not in control of her vehicle. Ruiz then chased the vehicle, while turning on the cruisers lights and siren.
The Ford kept increasing in speed through four way intersections and five red lights with cars coming in all directions. Ruiz attempted to speed up to get in front of the Focus when it was traveling at over 50 miles per hour to slow it down as quickly and safely as he could.
Ruiz stated he could see the panic on the woman’s face in his rear view mirror and brought both vehicles to a stop in the vicinity of Mills Avenue.
The driver identified as a 51 year old woman and resident of Tujunga, thanked the police officer over and over.
According to deputies there were no traffic accidents or collisions and the Ford Focus was heading toward a sharp curve onto Honolulu Avenue and if deputy Ruiz had not been able to stop the vehicle.
According to deputies later the vehicle was checked out and the brake fluid reservoir was empty and appeared to have a leak, causing the brakes to not work. I work for Ehline Law Firm PC at 4900 California Avenue Tower B, 2nd Floor Bakersfield, CA 93309 USA +661.846.2775.

Pharmacy Misfill Cases
AppId is over the quota
When having a prescription filled at a pharmacy, most people take for granted that their pharmacist will dispense the correct medication; however, pharmacy misfills and errors are more common than you may realize. The National Patient Safety Foundation estimates that out of approximately 30 billion prescriptions filled by outpatient pharmacies every year in the U.S., there are about 30 million pharmacy errors or misfills. The effects of these pharmacy misfills range from minor inconvenience to the patient to permanent disability or wrongful death. With an increased emphasis on timely customer service, pharmacies are under pressure to fill prescriptions quickly, which often leads to devastating mistakes. Pharmacy misfills are a form of medical malpractice and as such, patients who have suffered injury or lost a loved one due to a pharmacy mistake in Fort Lauderdale or throughout the State of Florida may be eligible to receive compensation for their injuries and losses.
Florida Pharmacy Misfills
Pharmacists and pharmacy technicians have a duty to carefully read prescriptions and dispense the medication exactly as indicated. Many medications have similar names, so it is vital that pharmacists take the time to read physician instructions carefully when filling prescriptions. In addition, pharmacists must be careful to review their patient pharmacy records to prevent potentially harmful or deadly drug interactions. Failure to do so may result in a pharmacy misfill including:
Dispensing the wrong medicationDispensing incorrect dosage – For example, dispensing 10 mg pills instead of 1 mg pills.Labeling prescription with incorrect use instructions – For example, indicating that a patient should take medication every two hours when the physician’s instructions indicate it is to be taken 2 times per day.Failure to label prescriptions with required warningsDrug contraindications – Filling a prescription for a medication that is known to have an adverse reaction to medications the patient is currently taken.Unfortunately, pharmacy misfills are one of the most difficult types of medical malpractice to detect; the adverse reaction to incorrect medication or incorrect dosages may be misdiagnosed as another medical problem. This is one reason why it is important to hire a Fort Lauderdale pharmacy misfill lawyer with comprehensive knowledge of pharmacology and the adverse affects that pharmacy misfills can cause.
Experienced Fort Lauderdale Pharmacy Misfill Attorneys
Kelley Uustal has represented many clients who have suffered injuries due to Florida pharmacy misfills. One example of a Florida pharmacy misfill case the attorneys at Kelley/Uustal handled successfully involved a pharmacy misfill to a 90-year old Florida woman, Minnie Guider, which resulted in brain injury and several weeks in the hospital. The woman’s mail order pharmacy company, Intramed, Inc., made an error when dispensing her bladder medication, Oxybutynin. Instead, they dispensed Glyburide, a prescription medication for diabetics that causes significant reduction in blood sugar levels. This pharmacy misfill resulted in hypoglycemic episodes and neurological insult to our client. While the defense claimed that Ms. Guider’s injuries did not result from the pharmacy misfill, the jury awarded our client $1.95 million for her medical expenses and for her pain and suffering.

Transvaginal Mesh Products
AppId is over the quota
Surgical mesh products are frequently used to repair weakened or damaged tissue in women suffering from pelvic organ prolapse or stress urinary incontinence. The surgical mesh can be implanted using traditional surgery or through the vaginal wall (transvaginally). Although considered a minimally invasive procedure, many women have experienced serious complications from the transvaginal implantation of mesh products, including infection, pain, and organ damage.
Pelvic organ prolapse (POP) occurs when organs in the pelvic area, such as the bladder, uterus, or rectum, slip out of place and drop into the vaginal wall; this often results from a weakening of supporting muscles during pregnancy and childbirth. Surgeons may use treat pelvic organ prolapse by implanting transvaginal mesh to reinforce the weakened vaginal walls. Women suffering from stress urinary incontinence (SUI) experience leakage of urine during physical activities such as sneezing, coughing, or laughing. Transvaginal mesh is often used to create a pelvic sling to support the bladder and urethra to alleviate the symptoms of stress urinary incontinence.
Between the years of 2008 and 2010, the FDA received 2,874 reports of complications from the use of surgical mesh inserted transvaginally to treat POP and SUI. This is more than double the number of adverse events to transvaginal mesh reported during the preceding three-year period. Due to the increased number of transvaginal mesh injuries reported, the FDA issued a warning in July 2011 stating that the risks of using transvaginal mesh to repair pelvic organ prolapse may outweigh the benefits to patients. In addition, the FDA has found no clear evidence indicating that inserting surgical mesh transvaginally is more effective than using traditional surgery to treat POP or SUI. Based upon the risks, the FDA urges physicians and their patients to consider alternative treatment options.
Manufacturers of transvaginal mesh products include Boston Scientific, C.R. Bard, Inc., American Medical Systems, and Ethicon. Commonly reported complications from the use of transvaginal mesh products include:
InfectionPainOrgan perforationInternal bleedingProtrusion of mesh through the vaginal musclesRecurrence of pelvic organ prolapse and/or stress urinary incontinencePain during intercourseUnfortunately, transvaginal mesh products are permanently implanted; therefore, it may not be possible to remove the mesh implants completely if complications arise. Many patients suffering complications from transvaginal mesh products require corrective surgery or other medical treatment, and some may suffer irreparable organ damage. In addition, complications can lead to debilitating chronic pelvic pain and infection and can adversely affect every aspect of a person’s life.
If you have suffered transvaginal mesh complications or injuries after treatment for pelvic organ prolapse or stress urinary incontinence, a transvaginal personal injury lawyer from Kelley/Uustal can help you determine whether you are entitled to compensation through a product liability claim. Pedestrian Hit by Police Officer Speeding Sues Huntington Beach—Claims He was on Cell Phone

September 23, 2011 - A woman has filed a lawsuit charging that a police officer hit her, while speeding and talking on a cell phone in Huntington Beach, during a car crash.
The woman identified as 47 year old Catherine Sanchez filed a lawsuit Monday in Huntington Beach stemming from a May 30th incident. Sanchez claims she was crossing Main Street when she was hit by an officer that was speeding and talking on a cell phone.
According to attorney Dyke Huish, who represents Sanchez, she would have been injured much worse if her son had not pulled her out of the way, but suffered bruising and pain to her back when she was struck by the police car on the left side of her body. Sanchez has claimed emotional distress due to the incident.
Attorney Huish stated that the officer stopped only long enough to yell at Sanchez to get out of the way and left. The Huntington Beach Police Department is denying the incident took place, while Huish has stated he does not believe police officers should be using cell phones and should not be permitted to leave the scene.
According to Huntington Police Department Chief Ken Small a police report was not taken, since the officer did not leave the scene and the woman was not struck by the vehicle. Small has stated that Sanchez did not say she was hit by the police vehicle and witnesses have also stated she was not struck by the car and because of this a report was not taken.
The Huntington Beach personal injury attorney at Ehline Law Firm PC finds the story believable. Michael Ehline, Esq., has seen several Santa Monica patrolmen on their cell phones while driving. According to officials of the National Championship Air Race, it is believed that a mechanical failure is what caused the P-51 Mustang named and piloted by Jimmy Leeward the Galloping Ghost to crash.
According to Air Races President Mike Houghton the plan was on course, prior to the malfunction, though there have been people reporting to have seen different things.
Authorities have stated that three people were killed during the crash including the pilot 74 year old Jimmy Leeward, a real estate developer from Ocala Florida. There were over 56 people injured and transported to local hospitals, with 15 being listed in critical condition and 13 listed in serious condition.

According to Ben Cissell, the plane crashed approximately 100 feet from where he was seated, but believes that Leeward pulled the plane up, which saved between 200 and 300 spectators from being injured or killed.
Spectator Kim Fonda says that Leeward was a hero for pulling the plane up at the last minute, causing it to crash about 25 feet from where people were seated. Attendant care claim lawsuit against citizens insurance - closed head injury
Our Michigan auto accident lawyers recently filed a first party Michigan No. fault insurance lawsuit for men and women in Wayne County Circuit Court in Detroit, Michigan. The no-fault insurance complaint arises from a 1991 car crash, in which the man suffered catastrophic damage, or a closed head injury. Because the husband requires its traumatic brain injury attendant 24-hour support.
An attendant care use claim was to the no-fault insurance company, citizens insurance. The insurance has refused these services need to Michigan law pay. The action is to pay the attendant care services, which the husband from his wife made available. Citizens has a part of these services, paid but correctly has paid hourly rate and for the correct number of hours. The complaint should also legal fees, costs and penalty interest for the wrongful refusal by the insurance company of this insurance claims.
