California car accident deaths decline, State wins federal funding

In April, the Department of transportation reported that 32,788 people in car accidents nationwide the lowest number were killed last year in 60 years. The statistics were impressive in California, the 2.715 accident deaths, a 12 percent drop below 2009 numbers and the lowest number since World War II report, in accordance with the Office of traffic safety. The California OTS announced Wednesday that the Government rewarded $ 76 million on the market Federal Security grants for this impressive drop in car-accident related deaths. California must with tight budgets get on the map this Fund and will support initiatives we hope, the improvement of pedestrian and bicycle safety clever.
It is true that vehicles the largest number of accident deaths in California, consisting of 43 percent of the State total accident of fatalities account for. But other accidents, including pickup trucks, motorcycles and pedestrians, the majority of road deaths in California and in the country for victims. In fact, because 13 percent of California deaths, a small part of despite, from which the State commuters, motorcycle accidents make up bikers are also more prone to accidents than car drivers.
Of course is not to say that efforts should continue to reduce its share of car accident deaths California. The decline was the result of consistent hard work by security officials statewide. "Well run road safety campaigns by law enforcement agencies throughout the State dangerous driver behavior targeting is a factor for the further reduction of transport-related deaths and wounded," California Highway Patrol said Commissioner Joe Farrow. "Through the behavior changes of public as buckling up driving ability a driver doesn't drink and eliminating distractions, daily, progress what to lives saved."
California is ready to use the 76 million in grants to improve road safety for the State of the driver. But more than anything else, the successful campaign to reduce the deaths accident proves that the State could implement similar discounts in motorcycle and pedestrian fatalities. Even more impressive future can this safer federal funds developed, reward to the State for the improvement of road safety across the Board lead.

A federal judge explains why ERISA sucks (believe me, it doesn't)
Judge William Acker, Jr. of the USDC Northern District of Alabama continued his assault on the judicial application of ERISA recently with his opinion of Blankenship v. Metlife.
Blankenship was Manager in a large Sears Roebuck store in Alabama, which had a significant cardiac history and suffered from advanced heart disease. His doctors said that he could continue his job in the stressful environment and he submitted to the disability. After several reversals on the MetLife part of the benefits was denied.
A short time later Blankenship knee surgery underwent and received benefits based on this condition. MetLife continue to verify the claim and had to check professional specialist of Blankenship's job functions. The specialist ignored his heart problem and focused solely on jobs that were open to anyone with knee problems. The specialist found several jobs, which excluded from his heart condition would have, and was again denied his claim.
Blankenship again appeal and MetLife had a cardiologist, review the file. The cardiologist never addressed the main concerns of the Blankenship doctors, the stress of work would cause him further cardiac episodes. Having regard to the report, MetLife denied the appeal.
His opinion, judge Acker ERISA is critical on some points. Cited first the problem with ERISA cases based solely on paper and the fact that the courts claim to "Credibility determinations, disputes between incompatible unsworn written testimony."With these questions the judge the weight given to experts for the insurance companies. These experts often present their opinions following a simple file review and without depending on the examination of the plaintiff. The reviews is this doctors then faced both the doctors.
Second field of the inherent conflict of interests facing the insurer in ERISA cases treated. The insurance that determine, even those who pay the benefits are that benefits should be granted. The possibility of this conflict and the apparent actions of insurers is secure enough to suspect that it is indeed an active conflict. Employees make decisions whether her give the employer money. This conflict as many are not practicing and file reviews make their living entirely on insurance also extends to the doctors set to verify the files. A conflict exists because a physician who is not ready to "deny, deny, deny" the insurance company loses business and suffer financial losses.
Finally harps of the judges on the perversion of ERISA, employee retirement income security Act, a law meant to protect the benefits of American employees by giving them access to the courts for denial-of insurance. Unfortunately, the courts have the spirit of the law defied, and it now serves as a bastion for insurance and not as a reprieve for the policyholders.

New federal regulations aimed to make safer buses
"The public deserves to know that if they get in any bus or vehicle, they their destination safely, will be delivered," LaHood said.
Some of the new measures include:
The US DOT now require a more stringent commercial driver's license (CDL) testing standards. new rules are to strengthen the carrier and driver compliance with Federal safety regulations are introduced.Consumer safety records are can display bus routes before booking a trip with them.FMCSA, will carry out with the help of local law enforcement agencies, surprise Motorcoach travel checks on popular destination spots during peak periods of travel.Other requirements are created:
The FMCSA is now get each application for a CDL to first require a commercial driver of learner's permit (CLP).All State licensing agencies must use a CDL test system, the American Association of motor vehicle administrators CDL knowledge and skills standards is equivalent to.The agencies prohibit the use of foreign language interpreters for test purposes amounted to reduce. To determine whether new carrier come try "unsafe old in business not only", are operated under a new business name, it establishes federal standards. The US DOT proposes that new motorcoach company is a full security check get active before the U.S. DOT authority.Current law is revised so that a driver CDL can be suspended or revoked for drugs and alcohol-related offenses committed in every vehicle outside of work.If airlines try passenger, without US DOT operating authority, the penalties are increased to $2500 per day of $2,000 per day.Consumers gain control
Consumers can now take you set up security in their own hands with the use of a Web site and system of FMCSA. The new bus passenger safety Web site: http://www.fmcsa.dot.gov/safety-security/pcs/Index.aspx by consumers, who are planning a trip on a support of motorcoach accessed can be. There they find a pre-trip home safety checklist, consumers with details of a bus company safety record, crash test and U.S. DOT authority is active. First, check this information, consumers can now informed decisions about whether or not they want to buy a ticket and travel with that institution.
The FMCSA promotes also bus passengers an unsafe bus companies, vehicle or driver report to them through their hotline on the site listed. By the consumer with this type of information that helps to keep safe this passengers and also help, federal regulators has been the vehicle for their security responsible.
Bus accidents
The FMCSA has taken a back seat when it with these carriers the federal standards to. Comprehensive security evaluations and controls of almost 4,000 passenger bus companies in the country has nearly doubled in the last five years. The inspections numbered about 12,000 in 2005 took but 25,000 inspections in the year 2010. Compliance was promoted to reviews by almost 500 in 2005 over 1,000 in the year 2010.
Although the FMCSA appears to be his job, to do sometimes new policies, procedures and regulations take time to implement and enforce. In the meantime continue to bus accidents occur to our country. Only the last week here in Georgia, MARTA traveled bus 13 passengers in Atlanta hit head-on by a car in the wrong lane. While in this particular case the MARTA bus driver not guilt was, the accident raises more secure to any questions about the bus passengers make. Most of the passengers in the crash of MARTA were injured, including a three-year-old girl. Security best practices for buses, such as secure Windows, stronger roofs, seat belts and better driving lessons and training have been pressing for over a decade. It is now time for security seriously taken, so that the safety of all passengers travelling.
