Roadcheck was in June and results are starting to be reported. So how did Texas do? On an ANNOUNCED inspection OVER 1 in 4 trucks was deemed to be so unsafe they were told to stop operating until they fixed a safety issue. The reported numbers from KMOO can be found HERE . The article stated in part:

During the 72-hour Roadcheck 2011 program last week, DPS and other Texas law enforcement agencies inspected 7,993 commercial vehicles. Of the vehicles inspected, 26.5 percent were placed out of service for safety violations. (emphasis added)

Is it any wonder that people are scared of 18 wheelers? Given the recent attempts by the Texas legislature to kill more Texans with trucks (see my prior blog on the impact of higher truck speed limits in Texas HERE) Texans have every reason to be scared.

Roadcheck 2011 - Unsafe Truck Drivers and Trucks on the Roads

Roadcheck 2011 - Unsafe Truck Drivers and Trucks on the Roads

The Commercial Motor Vehicle Safety Alliance (CMVSA) held  its Roadcheck 2011 event in June this year. This event asks for all states to inspect trucks on the road. Less than 1% of trucks are inspected. By announcing the inspections 4 months in advance, the CMVSA gives drivers and trucking companies four months to prepare, or if the problems are serious enough, to simply stay off the road for a few days.

Despite the huge publicity of the inspections in the trucking industry, the 3 day inspection in 2011 found almost 20% of the inspected vehicles and drivers failed a Level 1 inspection. The fact that truck drivers are on the road in an unsafe condition, knowing that this special inspection will be run, shows how drivers believe the chances of being inspected are so rare that they believe they won't be caught, or that they are so ill trained that they think they are safe.

Nationwide data show that in 2010, log book violations (logs are designed to keep tired drivers off the road) were the most common reasons for drivers being placed out-of-service at 29.5 percent of driver out-of-service violations. The most frequent out-of-service item for trucks was unsafe brakes comprising 25.5 percent of all vehicle out-of-service violations.

Thus the real danger: tired truckers, driving trucks with bad brakes, who don’t realize they are falling asleep until it is too late and who cant stop when they realize what is going on.

TEXAS LEGISLATURE VOTES TO KILL TEXANS WITH TRUCKS - Raises Speed Limits At Night for Tractor Trailers

Home > Safety > TEXAS LEGISLATURE VOTES TO KILL TEXANS WITH TRUCKS - Raises Speed Limits At Night for Tractor TrailersPosted on June 9, 2011 by Morgan Adams

The Texas legislature, in a fit of sheer stupidity (not a word my kids are allowed to say in my house so you know I feel strongly about the issue!) has raised the speed limits at night for tractor trailers in Texas.  (The Texas state senate passed this May 23, 2011 and it is now on its way to the Governor's desk. You can pray the Governor has the common sense to veto this! (See Transportation Topics, May 30, 2011 p25)) Texas already has one of the highest body counts in the nation for tractor trailer wrecks. According to the DOT, on average over the last 4 years, 410 Texans die each year in heavy truck crashes (stats can be found here).

I have to assume the Texas legislature had this pointed out to them. So what do they do with this knowledge? They raise the speed limit at night. Something that the Texas' own Commercial Driver's License Manual makes clear will kill YOU! Specifically the 2008 Texas CDL manual states (and it said this in the 2004 CDL manual as well, the oldest Texas CDL manual I have):

Driving too fast is a major cause of fatal crashes. You must adjust your speed depending on driving conditions. These include traction, curves, visibility, traffic, and hills. (2008 Texas CDL Manual Chapter 2.6)

You should always be able to stop within the distance you can see ahead... At night, you can’t see as far with low beams as you can with high beams. When you must use low beams, slowdown. (2008 Texas CDL Manual Chapter 2.6)

Whenever you double your speed, it takes about four times as much distance to stop and your vehicle will have four times the destructive power if it crashes. High speeds increase stopping distances greatly. By slowing down a little, you can gain a lot in reduced braking distance.  (2008 Texas CDL Manual Chapter 2.6)

Total Stopping Distance.  At 55 mph it will take about six seconds to stop and your vehicle will travel about the distance of a football field. (60 + 60 + 170 = 290 feet). (2008 Texas CDL Manual Chapter 2.6)

At night your headlights will usually be the main source of light for you to see and for others to see you. You can’t see nearly as much with your headlights as you can see in the daytime. With low beams you can see ahead about 250 feet and with high beams about 350-500 feet. You must adjust your speed to keep your stopping distance within your sight distance. This means going slow enough to be able to stop within the range of your headlights. Otherwise, by the time you see a hazard, you will not have time to stop. (2008 Texas CDL Manual Chapter 2.8)

Knowing this, KNOWING THIS, the Texas legislature goes and RAISES the nightime speed limit to 75MPH for tractor trailers! This means even if the truck driver is attentive and has his high beams on he cant stop in time.

Now I may not be bright compared to folks in the Texas legislature, but if my own book tells me at 55 MPH it takes a tractor trailer 290 feet to stop, and a tractor trailer driver can only see 250 feet at night with his low beams on, we have a problem. By the time a driver can see Something in the road IT IS TOO LATE TO STOP AT 55 MPH, much less 75 MPH. This problem even has a name, it is called "over driving" your headlights. Safety instructors, trucking companies, and truck drivers have known about this for decades. It is so well known it is even in the 2004 Texas CDL Manual!

If you, your children, or your parents have an engine problem or a flat tire at night, and cant get off the road, you are dead in Texas if a truck is behind you.

I have to think the Texas legislature loves truck companies lots more than us little folks in little cars.

Understand that the truck driver's are the fall guys here. If they are properly trained they will drive slower than the speed limit, within the distance they can see at night with their headlights. Truck companies generally don't train truck drivers that way because the faster the loads get delivered the more money a truck company makes. The victims are really you, me, and the truck drivers. I believe most truck drivers would follow the safety rules if they were properly trained.

The vehicle death rate in Texas from heavy trucks, which has been falling in recent years, is about to explode! Keep in mind that NAFTA is about to put Mexican trucks, which I don't believe are nearly as safe (see my prior blogs) as US licensed drivers and trucks, all over Texas as well! The next time you pass a graveyard in Texas make sure you take a moment to thank your Texas Legislators!

Accident risk by pickup trucks in Atlanta streets

Accident risk by pickup trucks in Atlanta streets

A woman was struck and killed by a piece of metal protruding from a truck in Clayton County. The pedestrian was not even on the road, but went into a green space on the side of the road. Law enforcement accident investigators indicated that they believe that a metal fence pole from the truck of a fencing company fell. The metal object struck the victim in the back of the head.

While most people accept that truck accidents with unsecured or incorrectly secured loads contain terms that pressures released a regular pickup from the bed include sometimes serious accidents in Atlanta and very Georgia. Pickup truck accidents can be the result correctly to ensure collisions or cargo in the bed of the truck.

Pickup truck accidents with ejecting cargo out of the truck bed are whether the truck is used for domestic use such as the transport of trash to the dump very often, regardless of, or work for a commercial use such as transporting supplies to a construction site. Many times pickup trucks are used as commercial vehicles and may in the bed, which can be very dangerous if it flies from the loading area carry cargo. The truck can also be that beyond the back of transported cargo such as wood or long poles, of pickup trucks are a threat to the vehicles after the rise.

Not properly loaded and poorly secured loads can jeopardize other driver force driver to take evasive action, because obstacles in the road. Large items may fall from the bed of a pickup, because it is not sufficiently linked to smaller load of back by strong winds or even a bump in the road can be done. During cargo fall into the ground is a significant risk accidents on Atlanta cause roadways, some pickup truck accidents can be caused even by elements, falling from the pickup truck and crash through the windscreen of a vehicle travelling behind or in an adjacent lane of the truck.

Pickup trucks are heavier and longer than many vehicles for passenger transport, which can make it even harder to drive than other vehicles for passenger transport. An inexperienced driver or one that is not the fundamental difference in the handling or a pickup truck braking are respected can be caused an increased risk of a Georgia pickup accident. Although tailgating or multitask while driving are always unsafe driving practices, they are especially dangerous when driving a pickup truck. If pickup trucks in collisions with a small car, such as a compact car, be involved the weight may indicate differential serious injury to the driver of the vehicle lighter.

When a pickup truck driver not properly secure the load in the bed of the vehicle or unsafe to drive, can the driver for a resulting accidents and injury or wrongful death caused by the accident. If a work truck, the truck is driven by an employee within the framework of the employment, the company, which employs the driver for a Georgia or Atlanta pickup-truck accident can be liable. Road check 2011 - unsafe truck drivers and trucks on the roads

Posted on August 15, 2011 by Morgan Adams

The commercial motor road check 2011 be held vehicle safety Alliance (CMVSA) event in June of this year. This event calls on all States to check trucks on the road. Less than 1% of the truck are checked. With the announcement of inspections of 4 months in advance, causing the CMVSA to create driver and truck companies four months, or if the problems around are just serious enough to stay away from the road for a few days.

Despite the huge advertising of inspections in the trucking industry the 3-day test in the year 2011 found nearly 20% of the inspected vehicles and driver failed a level 1 review. The fact that that lorry drivers on the road in an unsafe operating condition are to know, that this special inspection runs, shows how drivers believe that checked the chances are so rare that, that she will not be caught, or believe that they so badly trained that they think they are safe.

National data show that in 2010, log book injuries (protocols are designed to keep tired drivers from the road) the most common reasons for drivers, the out-of-service at 29.5 percent of the drivers of out-of-service violations have been brought. The most common out-of-service element for trucks was uncertain brakes with 25.5% of all Fahrzeug-Out-of-service violations.

Thus the actual risk: tired truck driver driving trucks with bad brakes that do not recognize they fall asleep until it is too late and who can stop when they realize what's going on.

WSP troopers hide in semi trucks, give 100 cards

WSP troopers hide in semi trucks, give 100 cards

In the last couple of weeks ago Washington State Patrol troopers have come drivers have been neglected with creative way often traffic laws and hopefully make the streets safer for us all to remember. When working in a Bellevue personal injury law firm in Seattle wrongful death lawyer knows I, and how quickly an auto accident can ruin several lives as it is important to follow the rules of the road.

Last week troopers in Marysville set up a sting operation at the railroad crossing on Highway 59, to catch drivers who stop on the tracks at a red light and not to cross signals to stop. This week's troopers are always a whole new perspective on just how dangerous the streets for some can be in particular lorry drivers. Sgt. Joe Bussmann with the State Patrol Rick Ragsdale went along with truck drivers, driver and dangerous manoeuvre on the road to catch. The plan was that Sgt. Bussmann would detect the driver and then drag the driver of the car information to waiting troopers, and ticket not only but also remind them of the risks, reckless driving would poses to everyone on the road, radio.

The sting operation lasted four hours, and in this short amount of time time of troopers made stops 112 traffic, 21 were driving style and 16 for the following to close. Has steadily increased the number of car accidents between cars and semi truck and troopers hope that their actions will driver results in environmentally friendly semi truck. It takes to realize not a genius, if you are involved in a car accident with a semi truck, the truck almost is guaranteed to win.

Mexican trucks still not safe for us!

Mexican trucks still not safe for us!

Posted on 25 April 2011 by Morgan Adams

The point is to enable again Mexican trucks full access to the United States under NAFTA. The proposed pilot program is available here. This was a bad idea in 2007, as I originally blogged on the topic here, and remains, today set a bad idea for reasons listed below:

Mexican companies have a process proposed 3-month period in the first phase only require three inspections per month during this period. In the second stage falling inspections, and the company more and unsafe trucks can run now, if they want to. After 18 months, the third phase goes into force, and after a check of conformity of the carrier extensive operational authority is given. Nothing prevents that Mexican society of 1-2-truck for the first time running, and then running hundreds of unsafe truck, as soon as power of Attorney given. This is only one of many possible fraud under this erroneous program can be run.The DOT Inspector General found in 2009, that the Mexican CDL database had problems with information and lack of information contained within the system.May be more than a CDL, hampered Mexican drivers which track dangerous truck driver with these licenses. This is for us CDL Treiber.Es still a problem, the implementation is more appropriately safe and efficient bus and lorry inspections at the border. The facilities and equipment are still Laking for a complete review Programm.Ausgebildete DOT inspection personnel are not sufficient to check a large number of trucks and buses. Today, check 1-2% of the truck in the United States. In the last ten years, how many more trained DOT inspectors were filed at the border? Who is looking at the DOT budget can quickly say that the number of inspectors is not increased over the years. In 1998 found 50% of the Mexican truck in order to service at the border.A position had 1,300 trucks every day with only an inspector (an inspector can do on a day of the IG Office 10-14-truck) and no inspectors had some sites.  U.S. truck have brakes managed by us certified brake inspectors, not Mexican truck companies. U.S. drivers are inscribed with their driving history for employers in the job of screening program (PSP), Mexican truck driver not. Controlled by the point in their business really DOT inspectors in Mexico we want Mexican company at their headquarters inspection?   Must be Mexican company certainly, but how sure? US companies have inspections and are of size, with most:

a. unsafe driving

b. tired driving

c. driver fitness

d. drugs and alcohol

e. vehicle maintenance

f. securing and load

g. crash history

In short, this is a bad idea. Good luck to find the Mexican driver after a wreck. Best of luck, with the deposit by a custodian of records somewhere in Mexico! Injured Americans have to pay more to get far less justice and it could be prevented all.

Currently almost 4,000 people a year die tractor trailers such as system crashes that safer U.S. inspected. Want to we really be there to find out how much is worse in this programme of NAFTA? I predict that the number of deaths rise on our highways about two years into force went into this program to it. I hope I me mad, and even more that this is never in force!

Now, call your Senators and congressmen and ask them to vote against!

TRUCKS breaking the law in Dallas

TRUCKS breaking the law in Dallas

From my injury law firm in Dallas we take a variety of truck and car accident cases. With so many 18-wheelers, DFW and Tarrant County driving around it is only natural that some accidents occur and when they do, they can have disastrous consequences.

But today there was a story on the channel 8 news, that really caught my attention - for the wrong reasons.

Truckers with dangerous, all mention of illegal chemicals drive all over Texas. It took 8 to sprinkle only 10 minutes by a Dallas County Sheriff in an 18-Wheeler with illegal corrosive substances through the center of Dallas news right.

Occur as often as truck accidents in the Metroplex, it is absolutely absurd that drive this truck through our cities, to break the law and the substances that so many people could harm, they would wreck!

I am glad that the travel Department looking Dallas Sherriff to truck driver is hazardous material by Dallas.

This comment was by Mark Anderson, board certified personal injury trial lawyer provided by the Texas Board of legal specialization. If you or a member of the family because of a truck accident or 18-Wheeler wreck was injured, give my law firm in Dallas a call at 817-294-1900.We apply to a free go over the events of your accident and talk about your legal options to set.
