October 18, 2011-According to reports an Orange County Sheriff’s deputy was arrested for suspicion of driving under the influence, while off duty.

According to authorities Orange County Sheriff’s deputy Mario Manuel Castro age 33 of Orange was charged Tuesday for driving under the influence of alcohol. Castro was stopped by police, according to prosecutors after being spotted driving on the wrong side of the road by an oncoming marked police cruiser.

Prosecutors said, Castro who was stopped on September 30th had a blood alcohol level of .24 after he was arrested, at approximately 2:00 a.m. in Orange. According to authorities Castro showed prevalent signs of intoxication, which included an unsteady balance and a strong odor of alcohol.

Castro who was off duty at the time had been drinking at a Costa Mesa bar, prosecutors have stated and has been charged with one misdemeanor account of driving under the influence with a prior conviction, one count of driving with a blood alcohol level of more than .08, with a prior conviction and a sentencing enhancement for having a blood alcohol level of over .15 percent.

Prosecutors stated that Castro had a prior conviction for driving under the influence of alcohol in 2009 in Los Angeles. The off duty Orange County Sheriff’s deputy faces a maximum of one year in jail if convicted. Castro is scheduled to appear at the Central Justice Center in Santa Ana on November 16th to be arraigned.

Orange County Sheriff’s Department spokesman Jim Amormino, stated that Castro is on active duty pending the outcome of an internal affairs investigation.

October 26, 2011 - You know, I see police on their cell phone all the time and frankly, this is absurd. Since when did the servants become our masters? So, it is with baited breath that I bring this discussion. According to reports a driver involved in a deadly crash, while talking on a cell phone could be facing homicide charges.

Now, here the facts are that the cell phone prompted the cop to make a stop. According to Concord Police 25 year old Mauro Gutierrez was seen by a Concord police officer talking on a cell phone without a hands free device on Hillsdale Drive, in the vicinity of Overhill Road at approximately 5:45 on Tuesday.

So, the selective enforcement of this law, led to a death. The officer attempted to stop Guiterrez, which turned into a chase southbound on Grant Street until the Highway 242 off ramp. This is where Guiterrez struck another vehicle resulting in the death of the driver of that vehicle.

Gutierrez then attempted to run and was caught approximately a block away from the crash. The 25 year old was arrested and allegedly was in possession of an illegal handgun. According to Concord Police, Gutierrez could be charged with second degree murder and will most likely face other charges for driving recklessly, fleeing from a police officer and violating the cell phone hands free law. The identity of the driver that was killed in the collision has not been released pending notification of their family. What do you think? With the amount of daylight quickly diminishing there are far more hours during the day when it is more dangerous for pedestrians to be out on the road. Yesterday morning Seattle police were called to an apartment complex to handle a disturbance and they were met with the most unlikely of scenes. A 21-year-old woman, who has not yet been named, was trapped underneath a car that had run her over, dragging her several feet. The Seattle fire department was called to help lift the car off of her and she was transported to Harborview Medical Center with minor injuries, but it was the story told to the SPD that makes this story truly unbelievable.

Police are unsure if drugs or alcohol were involved in this story but from what they have been able to gather it seems as though the young woman was extremely upset about something and decided to throw a fit and lay down in the parking lot. Her boyfriend, with whom she wasn’t fighting, was outside trying to calm her down when he saw an oncoming vehicle. He ran towards the car to warn the man about his girlfriend who was on the ground. But the driver thought the man was trying to attack him so he pressed on the gas, running over the woman.

September 26, 2011 - According to reports a woman was injured in a hit and run accident when trying to rescue a dog from the street.

According to San Diego Police Officer Dino Delimitros a woman identified as a 61 year old was injured in a hit and run accident in the 3500 block of Central Avenue in San Diego at approximately 11:30 p.m. Sunday.

According to Officer Delimitros the car that reportedly struck the woman was an older red four door Buick sedan, with damage to the front left side that was driven by a Hispanic man.

The 61 year old San Diego woman was transported to the hospital with a broken leg and lacerated liver and remains in serious condition, according to Officer Delimitros.

Authorities stated that the driver did not stop after hitting the woman, whose name has not been released.

Hopefully twice before texting and driving after hearing about the recent jury verdict people think.

A Robertson County, Texas jury has ordered to that a student almost 22 million dollars damages in a suit for wrongful death figures.  The jury came to the conclusion that Jason Reed Vestal texting and driving, which resulted in a serious car accident in November 2007.  This judgment is one of the largest in the history in case texting while driving.

Depending on the phone records Vestal sent and received 15 text messages, and seven phone calls of 45 minutes, which he rode before the fatal collision took place.  The accident claimed the lives of the 21-year-old Megan small Houston, was a senior at Baylor University.  Vestal of the truck collided head-on with small vehicle.

Vestal, said that he remember not everything from the accident and it's really hard to check whether it really caused his SMS.  He said that his phone records to only prove that there were text messages and phone calls, while he was driving.

Hunter craft, the lawyer representing family called this principle in the case. "No. 1 is the first time a Texas jury spoken according to their thoughts on SMS and drive and has spoken."  It was also the largest wrongful judgement ever to come from Robertson County death.  "I think this is probably a synonym for the egregious nature of Reed Vestal code of conduct in the case," said craft.

The family would like to use advertising about the case to push Texas to make illegal legislators SMS while driving in the State.

As we all know, Governor Rick Perry is growing increasingly with average Texan wishes and needs. Another example of this is his veto of House Bill 242 which would prohibit SMS while driving. This is despite numerous protests and evidence, legislators in Austin, which is an incredibly dangerous epidemic which increases control quickly distracted.

In its official veto Governor Perry says that, while "texting while driving reckless and irresponsible is" he believes the proposed law it is a step too far, since as "Government effort to micromanage the behavior of the adults." is to see well Yes, the point of the law it's not? Driving while intoxicated is illegal. Drunk drivers may be a danger for all in the privacy of their personal cars, but while they are on public roads. I think that should drive distracted similarly viewed.

The irony of the Perry's statement is that rather that each TEXTING while driving, those who recognize that the practice is dangerous instead should focus on educating the public, legislative lobbying. And collisions involving a dog leaning out of a fast-moving car are almost always fatal to the canine. Hitting your signal five seconds before you turn will give other drivers adequate time to adjust their speed and position.


6. Keep Your Inspection Up to Date. Yearly inspections can be tedious to keep up with, but they’re a necessary practice to ensure your safety and the safety of the Garden State’s roadways. Inspections prove that your vehicle is roadworthy – that it can withstand a crash and will not spontaneously break down on the highway where it would put both you and your fellow motorists at risk. Almost as importantly, driving when your inspection has expired is a misdemeanor in New Jersey and carries with it a $126 fine and an additional $30 court cost if you try to challenge it. That’s more than three times what a typical inspection costs. Take an hour or two and keep yourself legal.

Big dogs especially can cause accidents if they get excited, because they hinder the driver’s control of the vehicle. And collisions involving a dog leaning out of a fast-moving car are almost always fatal to the canine. A quick spin around the block is one thing, but if you really love Fido, keep him out of the car. He’ll be there when you get back.


10. Drive Defensively. If we could all read minds, there would certainly be fewer car accidents, but since we can never actually know what the drivers around us are thinking, it’s important to drive defensively. You never know when a drunk or distracted driver may swerve in front of or into you, so approach the roads with caution: always scan your surroundings so you aren’t caught unaware, be courteous and cautious when passing other vehicles and always allow yourself enough space to react to sudden changes in traffic.


11. Watch Out for Motorcycles. Summer is the most popular time to ride motorcycles, and even though bikes are smaller and harder to see in traffic, they have the same right to the road as cars and trucks. Motorcycles don’t offer nearly the same protection in a crash as other vehicles, so it’s crucial for the rider’s sake that you are alert and aware of any and all motorcycles around you on the road. 12. Make Sure Your Vehicle is Weather-Ready. It’s a common practice to winter-proof your vehicle, but do you make sure to summer-proof it as well? Nearly all gas stations have air filling stations on the premises, so keeping your tires inflated this summer is a no-brainer.


14. Put the Mascara Down. Ladies, we all know how important it is that you look stunning and presentable this summer, but trying to apply makeup while driving is just downright dangerous. If you’re looking at yourself in the mirror, then your eyes definitely aren’t on the road, and what would normally take a minute to do while you’re at home will take much longer behind the wheel. If you really don’t have enough time to apply makeup normally, allow yourself more time in the bathroom before you leave, or just find somewhere to pull over and apply your makeup so that you don’t have to explain to your car accident lawyer that your stick of mascara was the cause of a traffic accident.


15. Leave the Cell Phone Alone. Hands down, the leading cause of distracted driving is the cell phone. Mobile phones have improved the way we communicate with one another exponentially, but they’ve also surpassed alcohol as the leading cause of fatal car accidents. Screens on modern cell phones are small – and their buttons are even smaller – so tapping out a reply to that text message costs dangerous seconds. During that time, you’re oblivious to your surroundings, so if you get a text or a phone call while driving, your instinct should be to ignore it. If that’s too hard, try turning your phone on silent so you aren’t tempted. There’s no phone call that can’t be made just as well in a parking lot.

Virginia's new high prohibition is published SMS while driving another perfect example for passing as legislators with no courage a law then pat themselves on the back of the safety.

If she really wanted to make Virginia roads safer, she would ban cell phone use.

But they are not. You will only continue to taxpayer money "discuss" stupid, unenforceable laws like this waste.
