When an employee is injured in the workplace, they have the legal right to receive compensation for damages with a worker compensation settlement. All employers who have workman’s compensation insurance will need to file some paperwork in order to process the claim, and the injured worker must report the incident right away in order to ensure their claim gets filed appropriately. In most cases, either employer or their insurance provider will pay a lump-sum amount as the settlement, or provide worker’s compensation benefit payments over the course of several months.

Maximizing Your Worker Compensation Settlement Amount

Every party has its own set of considerations when a workplace injury has occurred. If the injured employee decides to settle his or her case, the insurance company will require a full release of his or her claim, and the wage loss portion and medical benefits will be lost forever. This is why it is so important to work with a worker’s compensation attorney. A qualified and experienced attorney can make sure that the injured worker is being fully compensated for their injuries, pain and suffering, and that they are not settling for an amount that will not cover all the costs related to their injury.

Another way to maximize your worker compensation settlement amount is to provide solid documentation to support your claim. This can include items such as:

Copies of medical bills and invoicesReceipts for equipment, supplies and products required for rehabilitation purposesPhotographs of the incident and damaged areasMedical reportsWitness testimonies

Evaluating Your Worker Compensation Settlement

Certain types of injuries have long-term side effects that may require advanced medical treatment and ongoing rehabilitative care. This has to be factored into the worker compensation settlement amount or the injured party will be responsible for paying for these costs out of pocket.

Working with a worker compensation attorney means that all of the short-term and long-term costs associated with the incident will be included in the settlement amount, so you won’t have to stress too much about paying an excess amount of out-of-pocket expenses when recovering from your injuries.

It’s important to consider the following costs when evaluating your worker compensation settlement:

Loss of wages and benefits because of the incidentLoss of consortiumDisfigurementEmotional sufferingRehabilitation costs, both short-term and long-termLoss of quality of life

Working with a worker’s compensation attorney can help to increase your worker compensation settlement amount and ensure that you will receive an appropriate amount for all damages you’ve incurred.

Chicago Roofing Accident Causes Worker Death

A roofer working on a building on West Superior Street became tangled in ropes as he was being lowered. Authorities said his chest was crushed, and he passed away at Northwestern Memorial Hospital within a few hours. Construction workers, especially roofers, encounter many serious hazards that can cause an injury or death. Improper safety systems and lack of training means that roofers must be mindful of the risk of falling when they go to the jobsite.

The National Institute for Occupational Safety and Health (NIOSH) notes that the number one cause of death for construction workers are falls. Unprotected edges should have either a guardrail, safety net, or personal fall arrest system. Roofs with hazardous surfaces, such as those with skylights, must be roped off. An average of 540 workers dies every year from falling off buildings, ladders, or scaffolds. Employers must maintain safe hoists, ropes, and auxiliary equipment and have guidelines to conduct periodic inspections of equipment.

At a minimum, employers must address each of these potential hazards:
- Do hoists have limit devices to ensure safety?
- Are weight loads for hoists marked for the operator?
- Are hoist controls visibly marked?
- Do hoists have working warning devices?
- Are hoist ropes maintained at proper length for full range of movement?
- Are contact points between ropes guarded?
- Are kinked ropes or substitutes discarded?
- Are only trained employees allowed to use hazardous equipment?

NIOSH also recommends that employers train workers to recognize and avoid unsafe conditions and have a safety supervisor inspect equipment before use. Checking for wear and tear and other conditions that could make the items faulty is crucial. With safety training, each worker should understand their role in monitoring for hazards as they complete their work. The Occupational Safety & Health Administration (OSHA) mandates that employers provide safety training and keep a log of the dates that workers are certified. Retraining is highly advised. In late August the Centers for Disease Control and Prevention hosted a “Prevention Through Design” conference to address workplace safety and design methods to prevent worker injuries and death.

Dallas Road Worker Seriously Hurt By Drunk Driver

Dallas Road Worker Seriously Hurt By Drunk Driver

Yesterday I wrote about a city of Irving worker getting hit by a suspected drunk driver while picking up highway cones and it seems another accident just like it happened in Dallas early this morning. A Dallas road construction worker was seriously hurt after a motorist hit him.

Dallas highway crews had the two right lanes of I-30 near St. Francis Avenue coned off when a Honda drifted into the construction zone and hit the worker. When police got to the scene of the accident they performed a field sobriety test on the Honda’s driver and what did they find? Well for one, that the guy was intoxicated and also a little white powdery substance in his pocket. Now the impaired driver faces an Intoxication Assault charge and possible more charges as authorities test the white powder in his pocket to see if it’s illegal drugs. (My guess is yes.)

Drunk or drugged drivers don’t only face criminal legal action against them for their crimes; their victims can take civil action against them, too. At the Anderson Law Firm in Fort Worth, we sue drunk drivers for hurting our clients. Many people don’t understand that the civil case is very different from the criminal case the drunk driver faces. Although the criminal case will get the drunk driver punished either by paying a fine, serving time or restricting a driver’s license – it will do nothing to pay back those that were innocent victims in the accident. Only in a civil case can you ever win money for the injuries the drunk driver forced you to have.

Learn about your legal rights after a drunk driving accident in DFW – you have a lot more options than you think.

Seattle Personal Injury Attorney | Construction Worker Killed in Belltown

Everyone knows that some jobs carry more inherent risk of serious injury than others, and one of the industries that carries higher than average risk for workers is the construction industry.  As a Seattle construction accident attorney, I often see some of the negative repercussions of the things that can happen to construction workers doing their job.  A man was killed on Thursday morning in a construction accident near the top floor of the McGuire Building in Seattle’s Belltown neighborhood, according to Inquisitr.com.  The McGuire is due to be demolished because it has been determined to be unsafe.  After the accident, the man was breathing and talking to his co-workers despite a neck injury, but by the time the Seattle Fire Department arrived, he was unconscious.  Medics were unable to revive him.   I wish I could say that a tragedy like this was a totally isolated incident, but unfortunately, fatal construction accidents do happen.

Looking at some reports on accident statistics provided by the U.S. Bureau of Labor Statistics, in 2009 there were over 90,000 missed work injuries to construction workers, and in 2010 there were 751 fatal occupational injuries to construction workers in the United States.  The article from Inquisitr.com reports that Thursday’s accident was the 32nd work-related fatality this year in Washington alone, and the 4th to a construction worker.  Four may not seem like very many, but when it comes to fatal occupational accidents in one state in one industry, it is four too many.  And it is certainly too many for the four Washington families that are left to grieve the loss of their loved ones.

While most construction accidents do not have such terrible outcomes as this one, there are many that nevertheless leave people, both workers and passersby, seriously injured.  If you or a loved one has been injured in a construction accident, you need an aggressive attorney to assess your situation, and help you decide whether there has been negligence.  Jason Epstein is an experienced Seattle construction accident attorney who will work to get you the compensation you deserve.  For more information, and a FREE CONSULTATION, call Jason at Premier Law Group at (206)285-1743.
