Posted On: October 11, 2011 by Mark A. Anderson

Three of the victims of yesterday’s fatal car wreck in Arlington have been identified as twin brothers Michael and Stephen Eckles, 21 (one of whom was driving), and Danielle Ruthstrom, 19. It is believed all three attended Seguin High School in Arlington. Two other victims who are still in critical condition at JPS Hospital in Fort Worth have not yet been publically identified.

Police still do not know what exactly caused the car in which the group was riding to go off the road and crash into a tree, splitting it in half before becoming engulfed in flames. There was speculation that alcohol was a factor as a liquor bottle was found at the accident scene, although a close friend of the Eckles brothers whose home they had left just prior to the collision reported that he noticed nothing unusual about either of them.

The deadly accident happened at approximately 3:00 am yesterday morning at the intersection of Southeast Green Oaks Boulevard and Yaupon Drive, close to Ferguson Junior High School.

I wish to offer my most heartfelt condolences to the families of Michael, Stephen and Danielle. I cannot even imagine the grief you must be experiencing right now. What happened with a tragedy. On behalf of everyone here at the Anderson Law Firm, and I’m sure across the Dallas-Fort Worth area, I want you to know that our thoughts are with you.

To the loved ones of those still in hospital: I wish your children as full and speedy recovery as possible. Our thoughts are with you also.

The danger of drinking and driving cannot be overstated.  As a Seattle car accident lawyer, I see entirely too many cases of people whose lives have been turned upside down by drunk drivers.  Late Sunday night, Candice Baima of Gig Harbor lost her life after a head-on collision with a 63-year-old driver who is believed by state troopers to have been under the influence, according to KIROTV.com.  Ms. Baima died at the scene of the accident, and her 14-year-old daughter, who was in the car with her, was taken to Mary Bridge Hospital.  The driver of the other vehicle was taken to St. Joseph Hospital.

As is the case in many fatal car accidents, this tragedy has left at least one child without a mother.  Ms. Baima’s family can never replace the loss that it has suffered, and certainly their focus at this terribly difficult time will be on mourning the loss of a loved one.   Sadly, they are not alone.  Nearly one third of the over 30,000 traffic fatalities that occurred in 2009 were alcohol related, according to the Centers for Disease Control and Prevention (CDC).  This statistic is a shocking reflection of a big problem in our society.

Mother and Child Killed in Tragic Accident

Mother and Child Killed in Tragic Accident

On September 28, a mother and her eight-year-old daughter were killed in an auto accident in Franklin Township near the intersection of Route 27 and Van Dyke Road. Niesha Middleton was traveling south on Route 27 with her two children when her Toyota entered the northbound lane and was struck by a Chrysler minivan taxi.

The accident happened as Middleton passed the vehicle in front of her. As she re-entered the right southbound lane, she lost control of the vehicle. After impacting a curb and blowing out a tire, her vehicle entered the northbound lanes, where it crashed.

Middleton, her daughter and her seven-year-old son suffered life-threatening injuries in the crash, and were transported to Robert Wood Johnson University Hospital. The driver of the taxi and its single passenger suffered a leg injury and an arm injury, respectively, and were transported to the same facility.

Middleton died of head and neck injuries on Thursday morning. Her daughter died on Wednesday evening. Her son’s condition is unknown. The taxi’s occupants are expected to make a full recovery.

Our deepest sympathy goes out Ms. Middleton’s family in the wake of their loss, and we wish her son, the taxi driver and the taxi’s passenger a speedy recovery.

The Danger of Everyday Driving

The accident that killed Ms. Middleton and her daughter illustrates some of the dangers of everyday driving. Things such as overcompensating during a turn or going too fast given road conditions may seem risky at worst, but in fact they can be fatal. This is why safety experts reiterate driving safety tips that may seem elementary. They’re anything but that.

Each year, car accidents kill over 40,000 people on U.S. roadways and injure 2 million. To avoid contributing to these statistics, drivers should learn which maneuvers and everyday road situations pose the most danger and then modify their driving habits accordingly. And if they are injured by the carelessness of another, drivers should contact a New Jersey accident attorney at Console & Hollawell, because a good attorney can help them secure the remuneration they’re entitled to.

Jodi DeSoto, wife of the late Superior Court Judge Hector DeSoto, was killed in a hit-and-run on Saturday, September 17th. DeSoto was crossing the street when she was struck by an SUV at around 8 p.m. on Rhode Place in Belleville, New Jersey. The vehicle fled the scene and Jodi DeSoto was taken to Clara Maass Medical Center in New Jersey, but died later that evening due to injuries from the accident. The incident remains under investigation as the driver of the vehicle in question has yet to be located and charged.

Our most sincere condolences go out to the family of Jodi DeSoto during this difficult time. We hope that the authorities are able to locate the driver of the SUV and arrest him for his part in the fatal accident.

Although pedestrian fatalities are down in motor vehicle accidents, the National Highway Traffic Safety Administration reports that 4,092 pedestrians were killed in traffic crashes in 2009 alone. The same study indicates that almost half (48%) of all pedestrian deaths occur on the weekend (Friday, Saturday, and Sunday).

According to DeadlyRoads.com, New Jersey state law mandates that “leaving the scene of a fatal accident is a 3rd degree crime, punishable by 3-5 years in state prison.” The same section also includes that “the presumption on non-imprisonment for 1st offenders does not apply to this crime and a sentence for this crime is imposed consecutively to convictions for aggravated manslaughter or vehicular homicide.”

If found, the driver of the vehicle that struck Jodi DeSoto has the possibility of facing criminal charges, jail time, and may be held responsible for compensating her family for their devastating loss. Victims of accidents like this hit-and-run, as well as their families may be entitled to compensation for medical bills, treatment, and other damages suffered from the accident. Stranded Pedestrian Killed In Fatal Accident Near The Colony

A garbage truck traveling northbound on the Sam Rayburn Tollway in The Colony hit and killed a stranded motorist that was trying to cross the highway. The motorist was hit around 6 a.m. after he attempted to cross Highway 121 between Main and Paige Road.

The truck accident caused a traffic nightmare for those driving the tollway as they had to use the highway’s frontage road during morning rush hour.

Unfortunately, stranded motorists are injured or killed all the time in DFW while changing tires, or like in this case, attempting to cross the road. Remember – there is an emergency number on the back of your Texas driver’s license you can call for roadside assistance. If you are stalled on an especially busy road or highway, call the police station and request that a squad car with warning lights wait nearby. These accidents are far too common, but can be avoided – especially if you use the resources available to you.

18-Wheeler Driver Killed In Arlington Wreck

18-Wheeler Driver Killed In Arlington Wreck

Posted On: September 27, 2011 by Mark A. Anderson

As a Dallas-Fort Worth personal injury lawyer, I’ve warned numerous times of the very real danger posed to cars and motorcycles alike by the huge 18-wheeler trucks which travel throughout the metroplex in ever-increasing numbers. A smaller vehicle doesn’t stand a chance against a much larger commercial truck and it’s inevitable that significant property damage and personal injuries are going to result.

Yesterday, however, a professional truck driver lost his life in a single vehicle wreck in Arlington. Police report that at approximately 4.15pm, a semi was driving west on Interstate 20, near Texas 360 when, the big rig somehow drifted off the highway and crashed on the roadside, apparently suffering severe damage to the cab portion of the truck. Authorities have not yet publicly identified the deceased trucker nor the cause of the crash.

While I would like to express my sympathy to the family and friends of the driver whose life was lost, I think we should also be thankful that no one else was injured in this terrible accident. This terrible tragedy serves to remind us all that despite their giant trucks, these men and women are just as vulnerable as the rest of us in the event of a collision.

Most of us don’t even think about how dangerous it is to get in the car and head out somewhere. We just don’t think about it. We do it every day, and yet we rarely stop to think that we’re really putting our lives at risk every time we are either a passenger or a driver on the roads of Dallas-Fort Worth. As a North Texas personal injury lawyer, I know that deadly wrecks happen throughout DFW on a daily basis. Some are caused by drunk drivers, but not every crash is the cause of such gross negligence.

evening.png

On Saturday afternoon, for example, Juana Mancilla, 71, of Grand Prairie, was killed in a fatal two-vehicle accident at the intersection of Dickey Road and Texas 161 in Grand Prairie. Mancilla was a passenger in an SUV which allegedly ran a stop sign putting in the path of a van which hit its side. According to police, Mancilla was ejected from the SUV which then rolled over, landing on top of her. She was pronounced dead at the scene.

Both the driver of the SUV, Jose Cruz Mancilla, 41, and the driver of the van, Billy Bannister, 71, as well with four additional passengers in the SUV were taken to hospital by ambulance to be treated with what were described as non-life threatening injuries.

I don’t want to speculate on the cause of this terrible accident, since clearly as a passenger in the SUV, Mrs. Mancilla had no control over the vehicle she was riding in at the time of the collision. Naturally, my thoughts and sympathies go out to all those who were hurt in the wreck, as well as their loved ones.

Unfortunately, while it does not appear that there was any significant negligence prior to this accident taking place, it goes to show just how suddenly and without warning an auto accident can occur. We should all realize that getting behind the wheel is the most dangerous thing we do every single day. And we should all resolve to take much greater care while driving around DFW.
