Pedestrian safety: Amtrak train accident in Southern California kills three men walking along tracks

Three pedestrians were killed on Monday, Dec. 13 when they were struck by an Amtrak train headed from San Diego to Los Angeles, according to KTLA News in Los Angeles. Thought to be possible taggers, the men in their early- to mid-20s were walking along the train tracks over Telegraph Road when the Amtrak train struck the pedestrians.

The conductor of the train tried to avert the pedestrian accident but could not apply the train’s brakes in time, causing a fatal collision with the men. LA County fire department and LA Sheriff Homicide detectives arrived on the scene shortly thereafter and pronounced the men dead.

A train accident is rare. Most often, pedestrian injuries occur on the road involving vehicles, and the risk of a pedestrian accident is higher than once thought: a pedestrian is killed every 120 seconds according to the National Highway Traffic Safety Administration. Pedestrian accidents generally occur because:

A driver has failed to yield the right-of-way to a pedestrian at a crosswalk. Generally, a pedestrian has the right-of-way for crossing the street, walking in a parking lot and on sidewalks. When a driver fails to give you the right-of-way, and if you’re injured as a result, you may be entitled to compensation for your injuries.Hit-and-run accidents. A hit-and-run car accident can frequently involve pedestrians. Try to gather license plate information if you can.A driver not making a complete stop. If a driver is not paying attention and fails to make a complete stop, s/he may not be able to see you on the road and can collide with you. In the case of the Amtrak train, even though the conductor was aware of the men traveling the tracks, he was unable to make a complete stop in time. This can often happen on the road as well.

Pedestrian safety is often overlooked as a possible public hazard. But unfortunately, accidents like these can happen anytime, but there are ways to avoid being hit as a pedestrian on the street.

To stay on the safer side of pedestrian travel, try to:

Wear white or bright clothing when walking. If you’re pro-pedestrian, then consider wearing brighter clothing so drivers can see you on the road.Use reflective vests. Bicyclists will find this tip extra useful because reflective gear can greatly increase your visibility, especially as oncoming headlights approach you. Cars can see you much more quickly using reflective gear versus dark, inhibitive clothing.Don’t J-Walk. Even if you think it’s safe, do not cross the road without using a crosswalk and following pedestrian safety rules. You never know when a car will take a turn out of nowhere and hit you.Don’t travel along railroad tracks. Even if you think you’re quick enough to get out of the way of a train’s path, don’t linger around or walk alongside train tracks. While this seems like an obvious tip, there are many travelers who use train tracks for longer distances since train tracks offer a more direct route without having to use street travel. Like the pedestrians killed in the Amtrak accident, it’s safer to simply stay on the sidewalk versus any alternative travel via train tracks.Don’t walk at night. As seen in a previous blog post involving a pedestrian accident in San Marcos, it’s never completely safe to walk at night, especially on busy areas near freeways and on-ramps. Avoid pedestrian activities at dusk and night hours.

Seattle Wrongful Death Attorney | Man Survives Collision With Train

Komonews.com reports that a pick-up truck was struck by an Amtrak train near Vancouver, WA on Monday.  The driver of the truck was taken to the hospital after the accident, and fortunately, suffered only minor injuries.  There was no other passenger, and there apparently was no damage to the railroad or the crossing.  As a Seattle personal injury attorney, I know how important it is to respect the danger that railroad crossings represent.  A train cannot stop quickly the way a car can, and with the weight of even a small train carrying a light load, the force of impact in a collision is tremendous.  It is always important to remember that trains cannot steer out of the way, and may not be able to stop, and exercise extreme caution around railroad crossings.

Every year, there are over 600 fatal train accidents in the United States according to information provided by the Federal Railroad Aministration, each of which leaves entire families grieving the loss of loved ones, and sometimes trying to make ends meet if the person lost was the primary source of family income.  Many of these accidents may have been prevented through the taking of due care around railroad crossings.  If your vehicle is ever stuck on a railroad crossing, look up and down the tracks and listen for the sound of a train.  You will probably hear a train coming before you see it, and if a train is coming, leave your vehicle and get yourself and any other occupants to safety.  Your car is not worth as much as your life and it is far better to lose your car than for your family to lose you.

If your family has suffered a loss in a train accident, your first priority is grieving your loss and trying to heal the pain that you feel.  An experienced Bellevue train accident attorney can work to take care of your family’s legal interests while you focus on the more important things.  Jason Epstein is a dynamic, compassionate attorney who can help you determine whether there has been negligence, and if so fight for the compensation you deserve.  For more information and a FREE CONSULTATION, contact Jason at Premier Law Group at (206)285-1743.

WSP quote 50 driver injuries in 3 hours for train crosses

As Seattle personal injury attorney working at a Redmond car accident law firm, I know that if you in a hurry, wait somewhere on a train to cross to get the last thing you want to do. You never know how long the train will take, and sometimes they stop even in the middle of the intersection, so you wait even longer. But so much of inconvenience can't wait for it to cross on the train, think of how devastating it would be for your family and friends you lose because you tried to beat the train.

The Washington State patrol and other local police forces have begun recently to sting operations in areas where consistently the same laws break a large number of drivers. Wednesday morning the Snohomish County Sheriff built MEPs and Marysville police evade a level crossing where drivers regularly try the railway safety gates along the highway 529 to actually 50 citations issued to 8 warnings, and strange a DUI in just under three hours. The citations and warnings went after the warning lights flashing on the driver, which is still running over the tracks and even stop on the tracks during a stop light.

A ticket for failure to comply with the warning lights or stop on the trail follow costs $124, a small price to pay in exchange for your safety and possibly your life. As a lawyer wrongful death Kent I know how difficult it is dealing with personal injury to an other negligence, and if a driver with a train colliding because she tried to beat the crossing gates, they are not only even injuries cause, they are potentially cause injury or even wrongful death of passengers and staff aboard the train. No life worth five minutes waiting time.

Inhabitants of Georgia efforts helps MARTA to prevent train accidents

To the Kensington MARTA Station was last month after MARTA train, train a man concerned faced. Without many witnesses and with the ongoing investigation it is clear whether the man was not at this time, fell or jumped onto the tracks.

The operator who likes VW MARTA even SMS at the time of the accident was his. It would be not the first time. Recently a commuter drove a photo of a driver MARTA with his cell phone to a text message send, while he was driving a train of full of passengers!

Commuters are not only passengers, but they are to protect their security and safety of other passengers investigators. Responsible for the photo, a passenger on the train, which had read an operator of one of the trains a book in the previous month experienced. He decided that he to do something.

Texting while operating a vehicle MARTA is against company policy, according to Andrea Coleman, spokesman for MARTA. Unfortunately limited to can the penalty on the operator administrative leave be placed with numbers , up an investigation is carried out. Effectively, calls a paid holiday the MARTA train operator during MARTA trying to determine why the train by train collided accident victims.

An attentive, in order to understand the extent of the risks in connection with a MARTA train is operator texting during operation of a MARTA train to check a few to do last commuter train accidents. In Los Angeles in the last year a Metrolink operator was texting and was so that he blew through a stop signal and an other train crashed distracted. He was killed along with 25 others, as a further 138 people were injured.

A trolley operator in Boston was SMS during the ride and radio message of an other trolley. The cars were completely thrown off their mark and 49 people were injured.

Some cities with the help of dedicated citizens started fight back against this kind of irresponsible behavior and ineffective sanctions. The Washington Metro implemented a new policy on texting in 2009 after a passenger one its operators recorded with a mobile phone in the service and posted the video on YouTube. The line of the old policy was a three strikes policy of sending SMS messages. The first offense would result in a five-day suspension while the second would result in a 10-day suspension. A commuter train operators would be subject to no cancellation up to a third offense. It took the embarrassing photos exposure before a new zero tolerance policy was adopted. Under the policy of zero tolerance a commuter train drivers immediately raised when caught with a mobile phone or handheld device while in the service.

These alert passengers, documenting instances of texting while operating commuter trains actually work at the to make safer u-Bahn lines such as MARTA. As a passenger on MARTA confidence Atlanta trained, residents, and that in the surrounding areas, that MARTA train operator will lead not unsafe direction such as texting while operating a MARTA train. Train hits car on tracks, seriously injured driver | Bellevue car crash lawyer

Train hits car on tracks, seriously injured driver | Bellevue car crash lawyer

There are the warnings on train tracks, which say that drivers and pedestrians alike to stay off the tracks when a train comes, for a reason. But as Bellevue car accident lawyer know I that train accidents are still claiming lives each year. These accidents are easily avoidable signs to railroad tracks.

A woman was seriously injured when an Amtrak train Thursday night in Everett collided with her Lexus. The train travelled South for Chicago, when it collided with the Mrs car at about 7 pm the woman was brought to Harborview Medical Center more serious condition. Researchers say that it considered that the woman on the tracks appears after the gates had reduced, but it is still too early to say. The car was pushed about 100 meters on the road due to an accident. A man on board, the of turn said that no one will be injured on the train. The tracks were additional code at 8 am, but investigators remained at the scene to find out what happened. Details of the crash were not available Friday morning.

It is always important to be aware when approaching a group followed by railroad accidents due to the devastating nature of the train. There are three steps you can take to ensure that you are involved in one of these accidents:

(1) Always yield to the trains. By look and listen, you can determine whether it is to a train. If exists, whether there are lights and bells at the intersection.

(2) Avoid trespassing on railroad tracks at all costs. It is private property and trespass is illegal and dangerous.

(3) Not illegally cross the tracks. It is illegal and dangerous to go or ride on the Rails, and you should cross only at certain intersections.

A train accident is rare. For the most part pedestrian injuries occur on the road, the vehicles, and the risk of pedestrian accident is higher than once thought: a pedestrian is every 120 seconds according to the National Highway Traffic Safety Administration killed. Pedestrian accidents occur in General, because:

A driver has not shown right of way for pedestrians at a pedestrian crossing. In General, a pedestrian has right of way to cross the street, walking in a parking lot and on sidewalks. If a driver not you think first, and if you are injured as a result, you are entitled to compensation for your injuries.Hit-and-run accidents. A hit-and-run car accident can often include pedestrian. Try to collect license plate information, if you can.A driver does not make a complete stop. If a driver not paying attention is and not stop to make, he/she may not be in a position, you see on the street and collide with you can. Travel the tracks at the Amtrak train although the conductor was aware of the men, he was able to halt in time to make. This can often on the road as also happen.

Pedestrian safety is often overlooked as a possible threat to the public. Unfortunately, accidents like this can happen at any time, but there are ways to avoid as a pedestrian on the road to be taken.

Try to stay on the safe side of the pedestrian travel:

Wear white or bright clothing on the go. If you are pro-pedestrian, then should you wear bright clothes so drivers can see you on the road.Use reflective West. Cyclists makes sense this tip extra because reflective gear significantly increased your point of view above all how you approach oncoming headlights. You can see much faster too dark, who require clothing cars with reflective gear when compared. Not J walk. Even if you, it certainly think not cross the road without a crosswalk and pedestrian safety rules. You never know when a car turn of nowhere is, and then press ENTER.Don't ride on the railroad tracks. Even if you, quickly enough you think to get out of the way of a train path are not to stay or walk next to train tracks. This seems like an obvious tip, but there is many travellers, the railway for longer distances as a more direct route railway without road travel to use. As the pedestrian in the Amtrak accident it is killed, stay safe, easy on the sidewalk versus any alternative journey of train tracks. Not to go at night.
