The FMCSA stated that it wants to be able to regulate shippers and brokers over the next five years. This is a good idea and a long time coming. The FMCSA strategic plan covers the goals from 2011-2016.

Brokers and shippers frequently make drivers carry over-limit loads, or require runs that either force the driver to speed or violate his hours of service limitations. I know we will hear more about this over the next five years. I will be interested to see the shipper and broker response as the American Trucking Association (ATA) supports the effort. Did you get that? The ATA and I agree on a safety issue!

Drive Safely Work Week is an Initiative All Employers Should Adopt

Drive Safely Work Week is an Initiative All Employers Should Adopt

October 3rd through the 7th is Drive Safely Work Week “Focus 360°: Getting There Safely Is Everyone’s Business.” No matter if you drive or carpool to work, or even walk or bicycle, there are important steps that individuals can take to lessen accidents. Chicago and Illinois employers have responsibilities too, and they should do everything possible to encourage best safety practices, particularly measures that limit distracted driving. The Network of Employers for Traffic Safety (NETS) set up this safety week to remind individuals that it is more important to get to work safely than to check email, text, or finish getting ready on the way to work.

Companies should adopt a mobile device policy. NETS says that employers should educate their workers to not use “any electronic device in any gear other than park.” Job expectations and productivity can still be met and employee safety is upheld when a company adopts this personal safety mindset.

Employees on their way to work should be focused on safely arriving to their destination, not texting, reading, or chatting on the phone. The same goes for people who walk or bike to their work. Using smartphones and iPods cause distractions as well. Distracted driving can ultimately cause serious injuries and deaths and is the number one cause of car and other motor vehicle accidents.

As Chicago personal injury lawyers, we see the aftermath of distracted driving. Briskman Briskman & Greenberg encourages area businesses and their senior management to implement the Drive Safely Work Week. NETS has workplace posters, daily activities, and contests to incorporate safe ways to get to work. The materials support safe practices for workers and their families to use, no matter how they get to work.

Briskman Briskman & Greenberg is a premier Chicago law firm that helps individuals and their loved ones take legal action to recover from serious injuries and wrongful deaths. What Should You Do When a Car Accident Really is Just an Accident?

What Should You Do When a Car Accident Really is Just an Accident?

AppId is over the quota
AppId is over the quota

Sometimes an accident is just that—an accident, a confluence of subtly timed car movements that results in an act of unforeseeable and completely unintentional consequences. No DWI, no reckless driving, just a bad hand of cards played for everyone involved.

Colliding with a Police Vehicle—Every Driver’s Worst Nightmare.

Unfortunately, such an accident recently involved two Philadelphia police officers and a pair of civilians. While responding to a call for backup in the afternoon, lights and sirens blaring, the police vehicle and a civilian vehicle collided. The impact was so strong that it propelled the squad car through a fence and into a nearby house.

Presently, Philly.com reports that the cause of the crash is under investigation. Suspicions that the civilian vehicle may have ran a stop sign are floating about, but as of yet no charges have been filed. The two police officers are recovering at Albert Einstein Medical Center, while the civilians were sent to Temple University Hospital. Console & Hollawell wishes both parties speedy and successful recoveries.

Making Preparations When Liability and Cause are Uncertain.

Regardless of what transpired in the scenario described, blameless accidents do happen. And navigating the choppy seas of legality and potential liability is the something best left to PA personal injury attorneys and PA car accident attorneys like Console & Hollawell. Whether such an accident involves a police vehicle or another civilian vehicle, the smartest, safest thing anyone involved in this type of accident can do is seek the expert advice of award-winning lawyers.

1 in 4 truck in Texas insecure and should not on the streets!

Posted on 16 July 2011 by Morgan Adams

Road check was in June and begin results are reported. So how does Texas? An ANNOUNCED inspection, which was considered to be of 1 in 4 trucks were so insecure they be told to stop operating until they fixed a security issue. You will find here the reported numbers of KMOO. The article explains in part:

During the 72-hour road check 2011-programme last week, DPS and other law enforcement agencies Texas reviewed 7,993 commercial vehicles. Of the vehicles checked, 26.5 per cent were from service for safety violations. (Emphasis)

Is it a wonder that people fear are 18 wheels? In view of the recent attempts by the Texas legislature to kill more Texians truck (see my previous blog on the impact of higher truck speed limits in Texas here) Texans, have every reason to fear.

Says Lady hit by train "railroad should have warned me"

Says Lady hit by train "railroad should have warned me"

Here is a lawsuit filed in Mississippi by the lady who take pictures on the trail, when a train behind her... was until she tries to get out of the way but could not stand. Bad injury, but this is a case?

I've always wondered how people.... get hit on trains, every time when I have been on a moving train, it seems noisy and makes the floor "move".

Anyway, as you can see the woman who was hit by the train during taking pictures will continue to read this complaint, it blames the railroad not to warn them that they should be not trespassing.

I am afraid that in this case may end up more than tort reform feed.

What do you think?

If you should the agreement be associated with the Apple iPhone like you went only have

A further frivolous lawsuit was filed. This time it comes to Apple Inc. and AT & T Inc.

A federal judge has a case against Apple and AT & T move it as a class-action.  The companies are accused of monopoly abuse.  Several will consolidate this suit was filed by consumers, the iPhone in early 2007 acquired.

Here are some of the questions that are raised in this ridiculous lawsuit:

The height of the control, the Apple of the applications of iPhone owners has allowed to install on their devices.Apple's practice of "lock" iPhones's so that she could be used only on AT & T Netzwerk.Die claim that Apple secretly AT & T its exclusive iPhone partner in the United States for five years made.Consumers agreed two-year contracts with the carrier, but were "effectively locked into a five year relationship with AT & T."These actions by the company damage "purportedly competition and drove the prices for consumers."
According to court documents, parts of the complaint, violations of antitrust law continued address to the as a class-action.  The class includes all consumers, the iPhone with a two-year-acquired AT & T contract since June 2007.

This complaint is stupid.  If you didn't like the idea of a two year deal with AT & T, which was apparently required to get the iPhone, you went away just have. This is Apple's business.  It is completely voluntary, to buy an iPhone the decision.

Should people really be remembered, not read & go?

Should people really be remembered, not read & go?

Distracted driving has a whole new level achieved. A current history shows in Portland, Oregon, that we now to the worry about other people, "read during the journey."

According to the associated press was allegedly a bus driver on video read an e-book, caught while driving.  The video which was shot by one of the passengers with a mobile phone, the bus driver showed how it seemed a Kindle look at or be other similar devices. The driver had the e-reader close to set up the steering wheel and low held view, as he drove the bus.   What is so frightening about this incident that the bus driver along Interstate 5 in Oregon, by everyone in the bus and in the vehicles around him in danger was on the road.

Not surprisingly, fired transit was the driver, 40-year-old Lahcen Qouchbane, violation of the Portland-area agency policy.  While the policy probably specifically not explain, "not your Kindle and drive, read" has made it fall under the category of "pose a direct threat to public safety," which is what Mr Qouchbane was accused of.

Mr Qouchbane lawyer, Jonah Paisner, reporters was not messages that read his client.  However, the video tells a different story.

Before this incident had occurred, the transit agency already received complaints about Mr. Qouchbane.  The Oregonian reported that he has finished in the year 2006 for printing the passenger, but was later reinstated.

What can we learn from this incident? Besides the fact that should never read and must drive you watch other drivers on the road. Does anyone know? The driver next to you a really great novel could in the Middle while behind the wheel.

Tort reform should be voluntary

Tort reform should be voluntary

Because the information about the health care Bill be developed further, there were numerous questions about tort reform and many heated debate.

Last fall, President Obama explains that he is at least the idea to urge Congress some type of tort reform provision would included in the health care bill.  So, friends the tort reform provision it in 2,000 + pages of health care bill?  According to the Wall Street Journal, included "the Senate a provision, the $50 million for grants to States that offer these projects would (order to medical tort reform check) want to start." And because the House effectively approved the Senate version of the Bill, that is, we're what front left with tortious act reform: $50 million in demonstration projects. "

The Senate must States that create this grant money, an alternative of to current tort litigation get.

I have to hear that imposing draconian caps on recovery for seriously injured people medical costs would reduce still no objective evidence. In fact, it is this group of people that would adversely affected the most by these caps and it returns a strong likelihood that she would ultimately forced onto public support leave.

Here is what I think about the reform of the tort - it should be voluntary.  If you think that the tort reform is a good idea to contract then why not with your medical provider in advance about your surgery, to limit your rest only in the event that medical misconduct?  You are free to do so, but I doubt that conveniently making such treaty would be you.

Bike helmet safety survey results: helmet laws should include children.

Bike helmet safety survey results: helmet laws should include children.

Posted on Monday, June 13, 2011

As the number of California continues to grow, cyclists is the debate over helmet bike laws front and Center are. Last year, Los Angeles Mayor Antonio Villaraigosa, his support for a national legislation, announced mandatory helmet for cyclists of all ages. Studies have shown that nine out of ten of the 130 annual bike accident deaths in California (and 700 nationwide) at least in part due to the decision No helmet wear. But California bicycle community was not receptive to helmet laws and even Villaraigosa welcomes announcement with boos.

In may as national bike we were curious month, like many Bay area cyclists use helmets and knowledge of the California helmet law. Our survey helmet safety asked five simple questions to bike helmet use for children, adults, parents and non-parents. Pie charts of the results are listed, with notes to specific demographics as responding. Take a look and share your thoughts in the comments section or on our Facebook page.

Funny Note: only 41% of women claimed, get their State helmet bike laws, compared to a whopping 75 percent of the men. A bit of mischief in the Bay area men, perhaps?

Not parents replied that they wear a helmet far more as parents. Only 45 percent of parents said that they have always a helmet, compared to 71 percent of non-parents. We set a good example for the children!

Everyone here agreed even though women were slightly more likely to say that children should be required to wear helmets (with 86%) than men (80%).

Although 71 percent of not parents said that they have always a helmet, only 39 percent thought, that they on this should be compared to 45 percent of the parents. And women were more likely to think that to require helmets for adults than men, by 45 percent to 35 percent.

55 Percent of men said they cycle to commute to work/school, compared to 23% of women. Writing in the for the category "other" include "Services," "I have often not an end" and "Everywhere!"
